From and after the enactment of this Part, it shall be unlawful for any person, firm, or corporation to allow or permit to remain upon any public or private grounds in the Township of Elizabeth, any growth of weeds and/or grass which are hereby declared public nuisances.

If the Township Ordinance Officer shall determine that the growth of weeds, grass and/or other vegetation exceeds the height of nine inches, the same shall constitute a public nuisance; the owner or owners of the ground upon which said nuisance exists shall cause the removal thereof to be done within seven days from the receipt of a written notice from the Township Ordinance Officer indicating that said weeds, grass or other vegetation is contrary to the terms and provisions of this Part. The Ordinance Officer shall deliver a copy of such notice to the owner or owners of property. The Ordinance Officer shall likewise affix a copy of said notice signed by him upon the property where the excess growth of weeds, grass or other vegetation exists, indicating that the same does constitute a public nuisance, and requiring the abatement thereof within seven days. Such date of affixation of such notice shall constitute the date of notice for purposes of this Part. Upon failure of the owner or owners to comply with said written notice of removal, the Township shall cause the removal of said nuisance to be done forthwith, and to collect the costs thereof, together with a penalty of 10% of such costs, from the owner or occupiers of the ground upon which such nuisance exists in the manner provided for by law for the collection of municipal claims, or by action of assumpsit.

It shall be unlawful for any person to wash, sweep, or blow grass clippings and/or vegetative material into stormwater drains, sanitary sewers, ditches, conveyances, water bodies or roadways of the Township of Elizabeth.

Any person, firm or corporation who shall violate any provision of this Part 2 shall, upon conviction thereof, be sentenced to pay a fine of not more than $600; and/or to imprisonment for a term not to exceed 90 days.
