There is hereby imposed upon the use of automotive-type trailers and/or construction trailers used in commercial and business enterprises the following limits and restrictions:
A. 
Business enterprises located and operating in the Township of Elizabeth shall be permitted to use no more than two trailers for purposes of storage or other use in conjunction with their businesses.
B. 
Any and all trailers used by any business enterprises shall be subject to a permit fee in the amount of $100.00, payable on an annual basis to the Township within 30 days of the trailer being brought on the premises, and thereafter on or before June 30 of each year that the trailer is in use. Use of a trailer at any time during the calendar year shall require payment of the aforesaid fee, irrespective of when in the year the trailer is brought into use.
C. 
All trailers used by a business enterprise, either under Subparagraph A or Subparagraph B above, shall be subject to all sideyard, setback and lot coverage regulations established under the Township Zoning Ordinance for the area in which the same are located.

This Part is to be applied only in business or industrial zoned areas in the Township and the above-described trailers are specifically prohibited from uses in all districts in the Township other than industrial or business.

Any person, business or corporation violating the terms and provisions of this Part shall be guilty of a summary criminal offense and subject to a fine in the amount of at least $100.00 and not to exceed $1,000.00 and/or a term of imprisonment imposed at the discretion of the District Justice having jurisdiction to hear the violation not exceeding 90 days. Each day that a trailer is used by any person in violation of this Part is deemed to be a separate offense.

The proper officers of the Township are directed to designate such person or persons to conduct such inspections as may be required under this Part, as well as to issue permits and carry out such other requirements as this Part imposes upon businesses in the Township who would seek to use trailers within the scope of this Part.
