§ 801 Procedure for Modification.

A. Any request for a modification or exception to one or more provisions of this chapter shall be considered by the Township Commissioners at a public meeting, provided that such modification or waiver will not be contrary to the public interest and that the purposes of this chapter are observed.

(1) Hardship. The literal enforcement of the provision will exact undue hardship because of peculiar conditions pertaining to the land in question.

(2) Alternative Standard. An alternative standard can be demonstrated to provide equal or better results.

B. All requests for modifications or waivers shall be submitted on an application form provided by the Township and be part of the subdivision and/or land development application. The request shall state in full the grounds and facts of hardship or evidence of equal or better result on which the request is based, the provision or provisions of the chapter involved, and the minimum modification necessary. The Township shall keep a written record of all actions on requests for modification.
