All scavenger waste disposal vehicles shall have all licenses
required by the State of New York, Rockland County Health Department
and the Town of Orangetown. Such licenses shall be available for inspection
at the treatment plant of the Town of Orangetown where it is proposed
to dump scavenger waste.

As used in this ordinance, the following terms shall have the
meanings indicated:
Any waste which is transported to the treatment plant by
a private carter or carrier.
Any waste which originates from a domestic or commercial
establishment, receives partial treatment on the site at which it
is generated by way of clarification/storage in an underground tank
and whose quality is principally human excrement or night soil.
The person appointed at the will of and by the Town Board
of the Town of Orangetown, County of Rockland, New York, in charge
of the sewage system. Same as "Superintendent."

The Town of Orangetown treatment plant will accept only scavenger
waste that has been obtained within the confines of the Town of Orangetown.
All waste from outside of the territorial limits of the Town of Orangetown
will be denied dumping privileges at the Orangetown treatment plant.

No septic tank or disposal facility within the Town of Orangetown
shall be emptied until inspected and approved by the Orangetown Sewer
Department. Inspections will be made during a working-day period which
is Monday through Friday, 8:00 a.m. to 4:00 p.m. prevailing time.
Upon the arrival of the Inspector at the job site and approval for
pumping, the septic facility may be pumped. Upon completion of the
pumping, the Inspector shall seal the intake of the tank truck. Scavenger
waste will then be delivered to a designated treatment plant where
the seal will be broken by plant personnel, at which time the waste
may be discharged into the plant facilities.

A.
The Director of the Sewer Department shall establish and
collect such fees for the dumping of septic or scavenger wastes, pursuant
to a schedule of fees, to be collected from any user dumping such
septic or scavenger wastes in the Town of Orangetown in the sewage
treatment plant or at such other place or places within the Town of
Orangetown or within the control of the Town of Orangetown. The Director
of the Sewer Department shall promulgate such rules and regulations
pertaining to the use of such sewage treatment plant and/or dump.
Such fees, rules or regulations or any amendment, alteration or modification
thereof shall not become effective until first submitted to and approved
by the Town Board of the Town of Orangetown.

B.
All fees, schedules, rules or regulations now established
by local law or by ordinance shall remain in full force and effect
until amended, altered or modified as hereinabove provided.

The decision of the Superintendent of Sewers of the Town of
Orangetown or his designated agent as to whether or not any pickup
has been made within the territorial limits of the Town of Orangetown
shall be final. The decision of the designated official of the Town
of Ramapo or the Town of Clarkstown as to whether or not any pickup
has been made within the territorial limits of their respective towns
shall be final. Nothing herein contained, however, shall prohibit
the Superintendent of Sewers of the Town of Orangetown from refusing
to accept a dumping if, in his opinion, the contents of the truck
contains wastes that originated outside of the limits of the Towns
of Clarkstown, Orangetown and Ramapo.

The Superintendent of Sewers shall determine what material may be discharged into the sewer plant. All material must be suitable, conditioned human excrement or night soil in a fluid state, and such material must be collected only from septic tanks, cesspools or package treatment plants, and the quality of the material discharged shall be within the regulations listed in Chapter 30A of the Code of the Town of Orangetown.

All emergency pumpings outside of the regular working hours,
as herein specified, shall be charged an additional fee of $50 per
inspection in the Town of Orangetown. All dumpings from the Towns
of Ramapo and Clarkstown outside of the regular working hours, as
herein specified, shall be charged an additional fee of $50.

Nothing herein contained will relieve any scavenger obtaining
permits hereunder from complying with any other provisions of all
ordinances, local laws and regulations of the Towns of Orangetown,
Clarkstown and Ramapo, the County of Rockland or the State of New
York or of any incorporated village within the Towns of Orangetown,
Clarkstown and Ramapo.
For failure to comply with these regulations, the privilege
of disposing scavenger wastes into the Orangetown treatment plant
may be suspended or revoked by the Superintendent of Sewers.

Any person, firm or corporation who shall violate any of the
provisions of this ordinance shall be guilty of a violation against
this ordinance and shall be subject to a fine not to exceed $50 for
each violation.

All portions of ordinances of the Town of Orangetown not consistent
herewith are hereby repealed.

This amendment of the ordinance shall take effect immediately
upon publication and posting as required by law.
