A. 
It is one of the purposes of this chapter to provide for the recovery of costs from persons who use the POTW in order to implement the programs established herein. The Town may adopt charges and fees which may include:
(1) 
Fees for monitoring, sampling, analysis, inspections and surveillance of industrial users at their facilities and within the sewer system.
(2) 
Fees for reviewing accidental discharge procedures and construction.
(3) 
Fees for consistent removal (by the Town) of pollutants otherwise subject to Categorical Pretreatment Standards.
(4) 
Other fees as the Town may deem necessary to carry out the requirements contained herein.
B. 
The applicable annual charges or fees shall be set forth each year by the Town Board as a line item or items in the Town's schedule of charges of fees presented at the budgetary hearing for the following fiscal year.
C. 
In addition to those annual fees, fees for reimbursement of the costs to develop and implement the Town's pretreatment program shall be charged to all industrial users which are issued wastewater discharge permits. These costs shall be recovered through a wastewater discharge permit fee, which shall not exceed $6,000 per year for each significant industrial user and $3,000 per year for all other industrial users issued wastewater discharge permits. In addition, all industrial users shall be billed for all sampling, collection and analysis costs incurred by the Town during its review of their permit applications.

D. 
These fees relate solely to the matters covered by this chapter and are separate from all other fees chargeable by the Town. Other charges established and imposed for users of the POTW are stated in Chapter 31.
A. 
The users responsible for the payment of the fees listed in § 30A-45 shall be the following:
(1) 
Fees for § 30A-45A(1) through (4) shall be charged to the user or users for which the Town incurs the costs, if such users can be identified.
(2) 
Fees for § 30A-45C shall be charged to the industrial user issued the wastewater discharge permit.
B. 
All applicable charges and fees shall be billed in accordance with the provisions of Chapter 31 of the Orangetown Code or on a fee-for-specific-service basis if Chapter 31 does not provide for payment of such fees.
A. 
Concentration limits.
(1) 
Industrial users discharging wastewater which exceeds the following concentrations for any of the conventional pollutants listed below shall pay a surcharge, as listed in Chapter 31 of the Code, for use of the POTW:

(2) 
The sampling methodologies to determine the concentrations of these pollutants shall be as specified in each industrial user's permit. The surcharge shall apply to the extent that the concentrations of these conventional pollutants exceed the levels stated above.
B. 
The surcharge threshold levels set forth above are not local limits. All pretreatment standards and pretreatment requirements, including the prohibition against pass-through and interference, do apply to discharges of the conventional pollutants listed above. In addition, nothing in this section shall prevent the Director from exercising his or her right, as described in § 30A-10 of this chapter, to require an industrial user to comply with specific discharge limits on these pollutants if deemed necessary to meet the objectives of § 30A-1A of this chapter. In the event that an industrial user receives specific discharge limits for any of these pollutants, no surcharge shall apply and violations of the discharge limit by the industrial user shall instead subject the industrial user to the enforcement provisions of this chapter.
