A.
All real property except one-family homes. On and after
the effective date of this local law, it shall be unlawful for the
owner and/or occupant of any parcel of real property located within
the unincorporated area of the Town of Orangetown, except a one-family
house, to permit any obstruction of any abutting or adjacent sidewalk,
except as authorized by permit from the Superintendent of Highways,
and such sidewalks shall be kept free and clear from ice, snow, dirt,
rubbish, garbage and any vegetation, including but not limited to
growth of hedges, trees or other plants, and any other obstruction.
B.
All real property. On and after the effective date of this
local law, it shall be unlawful for the owner and/or occupant of any
parcel of real property located within the unincorporated area of
the Town of Orangetown to permit any obstruction of any abutting or
adjacent sidewalk, public highway or public right-of-way, except as
authorized by permit from the Superintendent of Highways, and such
sidewalk, public highway or public right-of-way shall be kept free
and clear from dirt, rubbish, garbage and any vegetation, including
but not limited to growth of hedges, trees or other plants, and any
other obstruction.
It shall be the responsibility of the owner and/or occupant
to clean any sidewalk abutting any parcel of real property located
within the unincorporated area of the Town of Orangetown, except in
front of a one-family house and property appurtenant thereto, from
snow within six hours after the snow has stopped falling. Said sidewalk
shall be continuously maintained so that it shall be continuously
free of any accumulation of snow and ice.

In the event that any owner and/or occupant of any parcel of
real property located within the unincorporated area of the Town of
Orangetown, except a one-family house, shall fail to remove the snow
therefrom within the period of time herein provided or shall fail
to keep the sidewalks free from ice and snow, the Town of Orangetown
may remove such snow and ice from said sidewalk and charge the cost
of the same to the owner, which charge shall become a lien upon said
premises and, if not paid, shall be added to the state and county
tax bill next following the performance of the work.

In the event that any owner and/or occupant of any parcel of real property located within the unincorporated area of the Town of Orangetown shall fail to remove dirt, garbage, rubbish and any vegetation, including but not limited to growth of hedges, trees or other plants upon abutting or adjacent sidewalks, public highways or public rights-of-way, or any other obstructions after receiving five days' notice by the Orangetown Police Department or the Superintendent of Highways of the Town of Orangetown and/or the Deputy Superintendent of Highways of the Town of Orangetown and/or the Highway Maintenance Supervisors of the Town of Orangetown and/or the Director of the Office of Building, Zoning, Planning Administration and Enforcement, his subordinate Building Inspectors and/or Code Enforcement Officers, he shall be charged for the cost of removing the same in the same manner as provided for in § 32-3 for the cost of removal of snow and ice.
Any person desirous of obtaining a permit to temporarily obstruct
a sidewalk shall obtain a permit from the Superintendent of Highways
upon payment of a fee of $5. It shall be the duty of such person to
barricade the area and to provide warning lights, as required by the
Superintendent of Highways, from one hour before sunset to 1/2 hour
after sunrise.

In addition to any other civil penalties herein provided, any owner or occupant who shall violate any provisions of this local law shall be guilty of an offense against this local law and shall be punishable by a penalty as set forth in Chapter 41A of this Code.
This local law shall take effect immediately.
