This local law shall apply in that portion of the Town of Orangetown located outside the boundaries of any incorporated village.

A. 
Every person shall obey the instructions of any official traffic control device applicable to him placed in accordance with the provisions of this section, unless otherwise directed by a traffic or police officer, subject to the exceptions granted the driver of an authorized emergency vehicle as defined in the New York State Vehicle and Traffic Law.
B. 
No provision of this section for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that signs are required, such section shall be effective even though no signs are erected or in place.
C. 
Whenever official traffic control devices are placed in position approximately conforming to the requirements of this section, such devices shall be presumed to have been so placed by the official act or direction of lawful authority, unless the contrary shall be established by competent evidence.
D. 
Any official traffic control device placed pursuant to the provisions of this section and purporting to conform to the lawful requirements pertaining to such devices shall be presumed to comply with the requirements of this section, unless contrary shall be established by competent evidence.
E. 
For purposes of this section, "intersection" shall include the area embracing the juncture of a highway with a private road or driveway and "intersecting roadway" shall include an intersection private road or driveway.
F. 
Do not block intersection on Sickletown Road at Fifth Avenue (for vehicles traveling north on Sickletown Road) in the Hamlet of Pearl River.

A. 
No person shall operate a motor vehicle upon any public highway or private road open to motor vehicle traffic within the Town of Orangetown at a rate of speed in excess of 30 miles per hour except that said limit shall be 20 miles per hour within 300 feet in either direction from the building line of all schools abutting any highway. This section shall not apply to ambulances, fire vehicles or police vehicles when on emergency trips and shall not apply to state highways maintained by the State of New York.

B. 
The speed limit on Orangeburg Road between the westerly side of Lester Drive and the easterly side of Hunt Road shall be set at 45 miles per hour.
C. 
Sneden's Landing in Palisades: a sharp curve sign shall be erected by Pole No. 108 and a twenty-mile-per-hour speed shall be posted.

A. 
No vehicle shall be parked on any public highway within the limits of the Town of Orangetown between the hours of 2:00 a.m. and 6:00 a.m. prevailing eastern time during the period beginning November 15 and ending on April 15 of each and every year. The following named highways are excluded from the provisions of this local law:
(1) 
South Boulevard between the South Nyack village line on the north and Old Mountain Road in the hamlet of Upper Grand View on the south.
(2) 
Dexter Avenue in the Hamlet of Pearl River.
(3) 
The east side of Mountain View Avenue between Central Avenue and Orangeburg Road in the Hamlet of Pearl River.
(4) 
Garber Hill Road in the Hamlet of Blauvelt.

(a) 
Specific locations on specific streets:
[1] 
Clinton Avenue, on the south side, west of South Franklin Street.
[2] 
Cooper Drive, on the east side, between Clinton Avenue and White Avenue.
[3] 
Division Avenue, on the north side, from Depot Place to South Broadway.
[4] 
Shadyside Avenue, on the west side, from 381 feet south of the Route 9W intersection, and extending further south for an additional 300 feet to a point 680 feet south of the Route 9W intersection.
[5] 
South Boulevard, on the east side, from 600 feet north of Welles Lane continuing for 375 feet further north, wherein within this segment it is permissible for parking on the unpaved shoulder within the limits of the public right-of-way.

Overnight alternate-side-of-the-street parking is enabled on the following specific street segments, between November 15 and April 15, and as further described in Subsection A(5)(c), between the hours of 2:00 a.m. and 6:00 a.m. below.

[2] 
Elysian Avenue (an east-west street) between Maple Street and Prospect Street; and
[3] 
Washington Street (a north-south street) between Cedar Hill Avenue and Ross Avenue.
(c) 
Standards regulating overnight alternate-side-of-the-street parking.
[1] 
For those streets Subsection A(5)(b) above that are ascribed "north-south streets," unless otherwise posted, parking shall be permitted between 2:00 a.m. and 6:00 a.m. on the east side of the street only on Sundays, Mondays, Wednesdays and Fridays, and on the west side of the street only on Tuesdays, Thursdays and Saturdays.

For those streets in Subsection A(5)(b) above that are ascribed "east-west streets," unless otherwise posted, parking shall be permitted between 2:00 a.m. and 6:00 a.m. on the north side of the street only on Sundays, Mondays, Wednesdays and Fridays and on the south side of the street only on Tuesdays, Thursdays and Saturdays.
B. 
No vehicle shall be parked between the hours of 2:00 a.m. and 6:00 a.m., prevailing Eastern time, on the following public highways:
(1) 
In the Hamlet of Pearl River:
Central Avenue between Pearl Street and Middletown Road
Franklin Avenue between South Main Street and South Henry Street
Main Street between Jefferson Avenue and Washington Avenue
William Street between Franklin Avenue and Washington Avenue
(2) 
In the Hamlet of Sparkill:
Main Street from the Village of Piermont line to the Erie Railroad crossing
Union Street between Main Street and Route 340
(3) 
In the Hamlet of Tappan:
King's Highway between Old Tappan Road and Brandt Avenue
Old Tappan Road between Western Highway and King's Highway
Washington Street between King's Highway and Conklin Avenue
C. 
Residents of Cortwood Village are exempt from the parking ban, between November 15, 1998, and April 15, 2000, along the east side of Cortwood Road, Orangeburg, between Highview and Maple Avenues, provided that they obtain the required permit at a cost of $5.

No vehicle shall be parked on any public highway within the limits of the Town of Orangetown other than parallel with the edge of the street, headed in the direction of traffic and with front and rear wheels not more than six inches from the curb. This section shall not apply to Station Plaza in the Hamlet of Sparkill nor Station Plaza in the Hamlet of Pearl River, where angle parking is hereby authorized.
Except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or official traffic control device, no person shall, within the limits of the Town of Orangetown:
A. 
Stop, stand or park a vehicle:
(1) 
On the roadway side of any vehicle stopped, standing or parked at the edge or curb of a street.
(2) 
On a sidewalk.
(3) 
Within an intersection, except when permitted by official signs or parking meters on the side of a highway opposite a street which intersects but does not cross such highway.
(4) 
On a crosswalk.
(5) 
Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different distance is indicated by official signs, markings or parking meters.
(6) 
Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct traffic.
(7) 
Upon any bridge or other elevated structure upon a highway or within a highway tunnel, unless otherwise indicated by official signs, markings or parking meters.
(8) 
On any railroad tracks.
(9) 
On any portion of a public highway marked and designated by an official sign as a "bus stop," except a bus.
(10) 
On any portion of a public highway marked and designated by an official sign as a "taxi stand," except a taxi.

(a) 
A "taxi" shall be defined as a vehicle possessing valid New York State taxi, livery, or medallion registration and operated by a person possessing a valid Class A, B, C, or E New York State driver's license.
(b) 
No taxi shall be permitted to wait for longer than one hour in a taxi stand without leaving and returning to the rear of the taxi stand. Taxis within the taxi stand shall queue up in the direction of traffic, gradually moving forward as the taxi in front of them leaves or becomes occupied. There shall be no fee for use of a taxi stand by a taxi.
(c) 
The Town Board shall designate the location of any taxi stand by resolution.
B. 
Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers:
(1) 
In front of a public or private driveway.
(2) 
Within 20 feet of a crosswalk at an intersection, unless a different distance is indicated by official signs, markings or parking meters.
(3) 
Within 30 feet upon the approach to any flashing signal, stop sign or traffic-control signal located at the side of the roadway, unless a different distance is indicated by official signs, markings or parking meters.
(4) 
Within 20 feet of the driveway entrance to any fire station and on the side of the street opposite the entrance of any fire station within 75 feet of said entrance, when properly signposted, unless a different distance is indicated by official signs, markings or parking meters.
(5) 
Within 20 feet of any intersection unless a different distance is indicated by official signs, markings or parking meters.
(6) 
On Western Highway from Bataan Road south to Orangeburg Road.

C. 
Park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers, within 50 feet of the nearest rail of a railroad crossing, unless a different distance is indicated by official signs, markings or parking meters.
D. 
Stop, stand or park a vehicle within 15 feet of a fire hydrant, except when such vehicle is attended by a licensed operator or chauffeur who is seated in the front seat and who can immediately move such vehicle in case of emergency, unless a different distance is indicated by official signs, marking or parking meters.
E. 
Move a vehicle not lawfully under his control into such prohibited area or away from a curb such distance as is unlawful.
F. 
Stop, stand or park in violation of the restrictions stated on official signs when such signs have been posted prohibiting, restricting or limiting the stopping, standing or parking of vehicles on any highway.
G. 
In the Hamlet of Pearl River:

No standing on the west side of North William Street. Pearly River, northerly direction from the intersection of East Washington Avenue to the end of the dead-end street.
(2) 
No standing on either side of Veterans Memorial Drive (north and south) from the Gilbert Avenue intersection easterly direction to the Hunt Road intersection.
(3) 
No fishing at any time on the south side of the Veterans Memorial Drive bridge over Tappan Reservoir, Pearl River.
(4) 
No parking on the pavement along the north side of Jefferson Avenue, between Main Street and the railroad right-of-way.

I. 
Special vehicle identification permits.

(1) 
Upon application, the Town Clerk, with the approval of the Chief of Police, shall issue a special vehicle identification permit to:
(a) 
A licensed driver medically certified as suffering from a permanent physical disability seriously impairing mobility, who requires the use of his private automobile for transportation.
(b) 
A licensed driver requiring use of his private automobile to provide transportation for children similarly certified as disabled of which he is either parent or guardian or a person acting in place of said parent or guardian.
(2) 
A vehicle bearing such special vehicle identification permit, when parked, shall not be deemed in violation of any of the provisions of the rules and regulations governing parking in the Town of Orangetown, except where such vehicle shall be parked in a bus stop, a taxi stand, within 15 feet of a fire hydrant, a fire zone, a metered area, a fire lane, a firehouse, a driveway, a crosswalk or in violation of the two-hour parking limit or is double-parked.

(3) 
Any person to whom a permit has not been issued, and who shall use a permit issued pursuant to this section for any purpose other than parking a motor vehicle while transporting a physically handicapped person, shall be guilty of a violation within the meaning of the Penal Law.

The permit issued will be for the purpose of parking in specified areas as designated by official signs.

A. 
The Chief of Police, upon the recommendation of the Fire Inspector, subject to the approval of the Town Board, shall designate a traffic lane or other area designated for use by fire or other emergency vehicles on any street or in any other public or private street, driveway, parking area or place in the event of an emergency. Fire and emergency access lanes shall be in those locations and of sufficient design as may be reasonably required by the public safety and welfare. The purpose of these lanes is to guarantee unimpaired ingress and egress in and around public parking areas and to and around all buildings located in these areas, in the event of fire or other emergency, for police, fire and other emergency vehicles.
B. 
Said lanes shall be installed by the property owner with acceptable signs and paint on the pavement provided by said property owner and installed and maintained by the property owner, and of an approved design of the Bureau of Fire Prevention, and under the guidance and direction of the Chief of the Bureau of Fire Prevention.
C. 
Definitions. The words and phrases used in this section shall have the meanings respectively ascribed to them by Chapter 71, Title I, Article 1, of the Vehicle and Traffic Law of the State of New York.
D. 
It shall be a violation of these regulations to park any vehicles or store any containers, receptacles or other material within any lanes or areas designated as a fire lane or fire zone by the Fire Inspector.
E. 
All provisions of the New York State Fire Code shall apply to fire lanes.
F. 
Anything contained in this section or any other applicable law to the contrary notwithstanding, any vehicle parked in violation of this regulation shall be towed away by the Police Department or the Fire Inspector and stored at the expense of the owner, which expenses shall be paid prior to the redemption of the vehicle. Any change in property name or ownership shall not affect fire lane designation unless the Fire Lanes Law is amended and such amendment removes the fire lane designation from that property.
G. 
In the Hamlet of Blauvelt:
(1) 
BL 1: All interior roads of the property known as Bradley Industrial Park, 300 Bradley Corporate Drive (Section 65.18, Block 1, Lot 19), 500 Bradley Corporate Drive (Section 65.18, Block 1, Lot 21), 700 Bradley Corporate Drive (Section 65.18, Block 1, Lot 3) and 900 Bradley Corporate Drive (Section 65.18, Block 1, Lot 4), Blauvelt, New York, are hereby designated as fire lanes.
(2) 
BL 2: All paved portions of 589 through 597 Route 303, Blauvelt, New York (Section 70.10, Block 3, Lot 11), except designated parking stalls duly marked with pavement markings, are hereby designated as fire lanes.

BL 3: All paved portions of North Troop Realty, South Western Highway, Blauvelt, New York (Section 76.14, Block 2, Lot 44), except designated parking spaces duly marked with pavement markings, are hereby designated as fire lanes.

BL 4: The apron of and the parking lot entrance to the Blauvelt Volunteer Fire Company (Section 70.14, Block 1, Lot 32) shall be designated as a fire zone.

BL 5: Fire lanes are designated along the northerly and westerly curbing along the stores located on the western side of Westshore Plaza, LLC, located at 580 Route 303, Blauvelt, New York (Section 70.14, Block 4, Lot 13).

Pursuant to and consistent with existing Town Chapter 39, Article I, § 39-5.1, Fire lanes, if within the hamlet of South Nyack there is a proposed site plan or site plan amendment, and prior plans running with the land show fire lanes designated on any portions of associated public streets or public rights-of-ways, the location and arrangement of such fire lanes shall be shown on all plan submissions and shall not be removed or extinguished except in compliance with any applicable Town zoning standards, or the New York State Uniform Fire Prevention and Building Code, whichever is more restrictive.

Whenever traffic is controlled by traffic control signals exhibiting different colored lights or colored lighted arrows, successively, one at a time or in combination, only the colors green, yellow and red shall be used, except for special pedestrian signals carrying a word legend, and said lights shall indicate and apply to drivers of vehicles and pedestrians as follows:
A. 
Green indication:
(1) 
Vehicular traffic facing a circular green signal may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehicles turning right or left, shall yield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited.
(2) 
Vehicular traffic facing a green arrow signal, shown alone or in combination with another indication, may cautiously enter the intersection only to make the movement indicated by such arrow, or such other movement as is permitted by other indications shown at the same time. Such vehicular traffic shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection.
(3) 
Unless otherwise directed by a pedestrian control signal, pedestrians facing any green signal, except when the sole green signal is a turn arrow, may proceed across the roadway within any marked or unmarked crosswalk.

Vehicular traffic facing a steady yellow signal may enter the intersection; however, said vehicular traffic is thereby warned that the related green movement is being terminated or that a red indication will be exhibited immediately thereafter when vehicular traffic shall not enter the intersection.
(2) 
Pedestrians facing a steady yellow signal, unless otherwise directed by a pedestrian control signal, are thereby advised that there is insufficient time to cross the roadway before a red indication is shown, and no pedestrian shall then start to cross the roadway.
C. 
Dark period or red-green combined when shown following the green indication:
(1) 
Vehicular traffic facing such signal is thereby warned that the related green movement is being terminated or that a red indication will be exhibited immediately thereafter when vehicular traffic shall not enter the intersection.
(2) 
Pedestrians facing such signal, unless otherwise directed by a pedestrian control signal, are thereby advised that there is insufficient time to cross the roadway before a red indication is shown, and no pedestrian shall then start to cross the roadway.
D. 
Steady red indication:
(1) 
Vehicular traffic facing a steady red signal shall stop at a clearly marked stop line, but if none, then shall stop before entering the crosswalk on the near side of the intersection, or in the event there is no crosswalk, at the point nearest the intersecting roadway where the driver has a view of the approaching traffic on the intersecting highway before entering the intersection, and shall remain standing until an indication to proceed is shown.
(2) 
Unless otherwise directed by a pedestrian control signal, pedestrians facing a steady red signal shall not enter the roadway.
(3) 
When a sign is in place permitting a turn, traffic, except pedestrians, facing a steady red signal may cautiously enter the intersection to make the turn indicated by such sign after stopping as required by Subsection D(1) of this section. Such traffic shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection.

E. 
In the event an official traffic control signal is erected and maintained at a place other than an intersection, the provisions of this section shall be applicable except as to those provisions which by their nature can have no application. Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made, but in the absence of any such sign or marking, the stop shall be made at the signal.

Whenever special pedestrian control signals exhibiting the woods "Walk," or "Wait" or "Don't Walk" are in place, such signals shall indicate as follows:
A. 
"Walk." Pedestrians facing such signal may proceed across the roadway in the direction of the signal and shall be given the right-of-way by the drivers of all vehicles.
B. 
"Wait" or "Don't Walk." No pedestrian shall start to cross the roadway in the direction of such signal, but any pedestrian who has partially completed his crossing on the walk signal shall proceed to a sidewalk or safety island while the wait or don't-walk signal is showing.

A. 
Whenever an illuminated flashing red or yellow signal is used in a traffic sign or signal, it shall indicate and apply to drivers of vehicles as follows:
(1) 
Flashing red (stop signal). When a red lens is illuminated with rapid intermittent flashes, vehicular traffic facing such signal shall stop at a clearly marked stop line, but if none, then shall stop before entering the crosswalk on the near side of the intersection, or in the event there is no crosswalk, at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting highway before entering the intersection, and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign.
(2) 
Flashing yellow (caution signal). When a yellow lens is illuminated with rapid intermittent flashes, vehicular traffic facing such signal may proceed through the intersection or past such signal only with caution.

It shall be unlawful for trucks having a gross weight of vehicle plus load in excess of five tons to travel over Western Highway in the Hamlet of Blauvelt from the Town of Clarkstown boundary to Erie Street, with the exception of trucks making deliveries which originate or terminate in the Town of Orangetown.

A. 
Except as expressly permitted by the United States or the New York State Department of Transportation, and except where the requirement for local delivery will permit no alternate legal route, no person shall operate or move or cause or knowingly permit to be operated or moved on any public street in the Town of Orangetown any vehicle or combination of vehicles of a size or weight exceeding the limitations provided for this section.
B. 
Width.
(1) 
The width of a vehicle, inclusive of load, shall be not more than 96 inches, plus safety devices, on any Town highway in the Town of Orangetown.
(2) 
The provisions of Subsection B(1) of this section shall not apply to vehicles and implements or combinations thereof not over 13 feet in width, used solely for farm purposes, during the period from sunrise to sunset, provided that at least two red flags not smaller than 24 inches square be displayed on the left front and rear of each vehicle or implement or combination thereof in such manner as to be clearly visible from the front and rear for a distance of at least 500 feet. However, no such vehicles, implements or combinations thereof shall be operated on any highway after 10:00 a.m. on any Saturday, Sunday or legal holiday, except for trips of two miles or less.
(3) 
The provisions of Subsection B(1) of this section shall not apply to omnibuses or buses used solely for the transportation of children to and from school, but the width of such omnibuses shall not exceed 98 inches.
(4) 
Notwithstanding the provisions of Subsection B(1) of this section, racks for carrying hay, straw or unthreshed grain may have a width of 10 feet at the top of the rack. In no case shall the width at the base of the rack exceed 102 inches at any portion thereof while on any Town highway.
C. 
The height of a vehicle from the underside of tire to the top of the vehicle, inclusive of load, shall be not more than 13 1/2 feet. Any damage to highways, bridges or highway structures resulting from the use of a vehicle exceeding 13 feet in height where such excess height is the proximate cause of the accident shall be compensated for by the owner and operator of such vehicle.
D. 
Length.
(1) 
The length of a single vehicle, inclusive of load and bumpers, shall not be more than 40 feet unless otherwise provided in this subsection.
(2) 
The length of a semitrailer or trailer shall not exceed 45 feet except as provided in this subsection; provided, however, that the length of any trailer or semitrailer being operated in combination with another trailer or semitrailer shall not exceed 28 1/2 feet.
(3) 
The length of buses having a carrying capacity of more than seven passengers shall not exceed 45 feet, except that the length of articulated buses shall not exceed 62 feet.
(4) 
The provisions of this subsection shall not apply to fire vehicles.
(5) 
Any semitrailer with a length not to exceed 48 feet may be operated on any Town highway, provided that the total length of a combination of vehicles, including such a semitrailer, does not exceed 60 feet.
E. 
Additional restriction on length; exceptions.
(1) 
The total length of a combination of vehicles, inclusive of load and bumpers, shall not be more than 60 feet.
(2) 
The provisions of Subsection E(1) of this section shall not apply to:
(a) 
Vehicles of a corporation which are subject to the jurisdiction of the Interstate Commerce Commission, the Public Service Commission or other regulatory body and which are used in the construction, reconstruction, repair or maintenance of its property or facilities, provided that any such vehicle complies with the safety requirements of the laws and regulations of the United States and of New York State pertaining to over-length vehicles;
(b) 
Vehicles hauling poles, girders, columns or other similar objects of excess length, provided that any such vehicle complies with the safety requirements of the laws and regulations of the United States and of New York State pertaining to such over-length vehicles;
(c) 
Fire vehicles; and
(d) 
Any vehicle or combination of vehicles which is disabled and unable to proceed under its own power and is being towed for a distance not in excess of 10 miles for the purpose of repairs or removal from the highway.
(e) 
State and/or municipally owned vehicles engaged in snowplowing, ice clearing or other emergency-type operations.
(3) 
Notwithstanding the provisions of Subsection E(1) of this section, a bumper overhang of not more than a total of three feet on the front and four feet on the rear of the vehicle shall be permitted.
F. 
In determining the number of wheels and axles on any vehicle or combination of vehicles within the meaning of this section, only two wheels shall be counted for each axle, and axles which are less than 46 inches apart from center to center shall be counted as one axle. However, in the case of multiple tires or multiple wheels, the sum of the widths of all the tires on a wheel or combination of wheels shall be taken in determining tire width.
G. 
Subject to the provisions of the section of this chapter governing maximum vehicle gross weights, the weight per inch width of tire on any one wheel of a single vehicle or a combination of vehicles equipped with pneumatic tires, when loaded, shall be not more than 800 pounds.
H. 
Subject to the provisions of the section of this chapter governing maximum vehicle gross weights, the weight on any one wheel of a single vehicle or a combination of vehicles, equipped with pneumatic tires, when loaded, shall be not more than 11,200 pounds.
I. 
Subject to the provisions of the section of this chapter governing maximum vehicle gross weights, the weight on any one axle of a single vehicle equipped with pneumatic tires, when loaded, shall be not more than 22,400 pounds.
J. 
Subject to the provisions of the section of this chapter governing maximum vehicle gross weights, the weight on any two consecutive axles of a single vehicle or a combination of vehicles equipped with pneumatic tires, when loaded, and when such axles are spaced less than eight feet from center to center, shall be not more than 36,000 pounds, except where axles are spaced eight feet or greater, but less than 10 feet, the weight on those two axles shall not exceed that permitted by Subsection K(2) of this section and, in addition, shall not exceed 40,000 pounds. Axles shall be counted as provided in Subsection F of this section.
K. 
Subject to the provisions of the section of this chapter governing maximum vehicle gross weights, a single vehicle, or a combination of vehicles having three axles or more and equipped with pneumatic tires, when loaded, may have a total weight on all axles not to exceed 34,000 pounds, plus 1,000 pounds for each foot and major fraction of a foot of the distance from the center of the foremost axles to the center of the rearmost axles. Axles are to be counted as provided in Subsection F of this section. In no case, however, shall the total weight exceed 80,000 pounds. For any vehicles or combination of vehicles having a total gross weight less than 71,000 pounds, the higher of the following shall apply:
(1) 
The total weight on all axles shall not exceed 34,000 pounds, plus 1,000 pounds for each foot and major fraction of a foot of the distance from the center of the foremost axles to the center of the rearmost axles; or
(2) 
The overall gross weight on a group of two or more consecutive axles shall not exceed the weight produced by application of the following formula:
W = 500 [(L XN)/(N-1) + (12XN) + 36]
Where W equals overall gross weight on any group of two or more consecutive axles to the nearest 500 pounds, L equals distance in feet from the center of the foremost axle to the center of the rearmost axle of any group of two or more consecutive axles and N equals the number of axles in the group under consideration, except that two consecutive sets of tandem axles may carry a gross load not to exceed 34,000 pounds, provided that the overall distance between the first and last axles of such consecutive sets of tandem axles is 36 feet or more. For any vehicle or combination of vehicles having a total gross weight of 71,000 pounds or greater, this Subsection K(2) shall apply to determine maximum gross weight which is permitted hereunder, subject to the provisions of the subsection of this section governing maximum vehicle gross weights.
L. 
No vehicle shall be operated on the public streets of the Town of Orangetown other than on pneumatic tires.
M. 
For the purpose of this section, the width of pneumatic tires shall be ascertained by measuring the greatest width of the tire casing when the tire is inflated.
N. 
No person shall operate or move a vehicle or a combination of vehicles over, on or through any bridge or structure on any highway if the weight of such vehicle, or combination of vehicles, and load, is greater than the posted capacity of the structure or exceeds the height of the posted clearance as shown by an official sign.
O. 
If a vehicle or combination of vehicles is operated in violation of this section, an appearance ticket or summons may be issued to the registrant of the vehicle, or, if a combination of vehicles, to the registrant of the hauling vehicle, rather than the operator. In the event that the vehicle is operated by a person other than the registrant, any appearance ticket or summons issued to the registrant shall be served upon the operator, who shall be deemed the agent of the registrant only for the purpose of receiving such appearance ticket or summons. In addition, a notice containing all pertinent information relating to the charge which is contained on the summons or appearance ticket shall be mailed by or on behalf of the person who issued the appearance ticket or summons to the registrant at the address given on the registration certificate for the vehicle or, if no registration certificate is produced at the time the appearance ticket or summons is issued, to the address of the registrant on file with the Department of Motor Vehicles of said state within five days after the date of issuance of the appearance ticket or summons, but at least five days before the return date specified on the appearance ticket or summons. Proof of mailing to the registrant under this section shall be filed with the court in which the appearance ticket or summons is returnable on or before the return date. The provisions of this subsection shall not apply to owner-operators of any motor vehicle or to any motor vehicle or trailer which is registered in the name of a person whose principal business is the lease or rental of motor vehicles or trailers unless the motor vehicle or trailer is being operated by an employee of the registrant or for a community of interest other than the lease or rental agreement between the parties to the lease or rental agreement.
P. 
In any case wherein the charge laid before the court alleges a violation of this section, any plea of guilty thereafter entered in satisfaction of such charge must include at least a plea of guilty to a violation of one of the subsections of this section. No other disposition by plea of guilty to any other charge in satisfaction of such shall be authorized; provided, however, that if the prosecuting attorney, upon reviewing the available evidence, determines that the charge of a violation of this section is not warranted, he may consent, and the court may allow, a disposition by plea of guilty to that or another charge in satisfaction of such charge; provided, however, that the court must impose at least the minimum fine as authorized in this section for the offense.
Q. 
Violations and penalties.
(1) 
A violation of the provisions of this section shall be punishable by a fine of not less than $200 nor more than $500, or by imprisonment for not more than 30 days, or by both such fine and imprisonment, for the first offense; by a fine of not less than $500 nor more than $1,000 or by imprisonment for not more than 60 days, or by both such find and imprisonment, for the second or subsequent offense, in both cases plus the fine provided in Subsection Q(2) of this section.
(2) 
A violation of the provisions of this section by any vehicle or combination of vehicles whose weight exceeds the weight limitations as set forth in any of these sections, or the weight limitations specified by a permit issued by the United States or New York State Department of Transportation, shall be punishable by fines levied on the registered owner of the vehicle or vehicles, whether at the time of the violation the vehicle was in the charge of the registered owner or his agent or lessee in accordance with the following schedule (in addition to the fines as prescribed in Subsection Q(1) of this section):

A violation of the provisions of this section by any vehicle or combination of vehicles whose weight exceeds the weight limitations specified by a permit issued by the United States or New York State Department of Transportation shall be punishable by fines levied on the registered owner of the vehicle or vehicles, whether at the time of the violation the vehicle was in the charge of the registered owner or his agent or lessee, in accordance with the following schedule in addition to the fines as prescribed in Subsection Q(1) of this section:

Where the excess axle or axles' weight is greater than the limits specified by a permit issued by the United States or New York State Department of Transportation, the permit shall, for the purposes of computing the fine, be deemed void, and the amount of the fine shall be determined in accordance with the maximum weight which would have been in effect for the operation of such vehicle if the permit to exceed such maximum weight had not been issued.
(4) 
In connection with the weighing of a vehicle or combination of vehicles, if it is found that there is a violation of Subsection K and also of Subsections I and J or both Subsections I and J of this section, there shall be a single fine imposed, and the maximum amount of such fine shall not exceed the highest fine that could be imposed under this section.
(5) 
The court may impose any sentence authorized by this section; provided, however, that any such sentence must include a fine as provided in this section.
(6) 
All fines collected as a result of the above schedule shall remain the property of the Town of Orangetown.

The following regulations shall apply to the parking lots maintained by the Town of Orangetown to the front of and to the rear of the Orangetown Town Hall:
(1) 
No person shall stop, stand or park any vehicle in said parking lots except when the driver or a passenger in said vehicle is present at said Town Hall in connection with Town business.
(2) 
No person shall stop, stand or park any vehicle in said parking lots in violation of the restrictions stated on official signs posted therein.
B. 
The following regulations shall apply to Town Hall Road between the west parking lot, maintained by the Town of Orangetown, and Orangeburg Road:

No person shall park left side to the curb on the west side of Town Hall Road from the parking lot to Orangeburg Road, a distance of 194 feet.
(2) 
No person shall park left side to the curb on the east side of Town Hall Road from the parking lot to the storm drain, a distance of 133 feet.

No person shall park on the east side of Town Hall Road from the parking lot to the storm drain, a distance of 133 feet.
C. 
Parking shall be restricted on both sides of Town Hall Road from the intersection of Orangetown Road in a northerly direction to the parking lot.

The regulations following shall apply to the specific locations and premises of the Pearl River School District as herein specified.
C. 
Specific regulations for individual school premises are as follows:
(1) 
Regulations for Evans Park Elementary School.
(a) 
All vehicles entering on the premises of said school shall enter from Marion Place and shall exit via Patton Place.
(b) 
All posted signs and road markings are to be observed and parking shall be only in the designated area.
(c) 
Only one-way traffic (east) shall be permitted on the roadway leading from Marion Place to Patton Place.
(2) 
Regulations for Franklin Avenue Elementary School.
(a) 
All vehicles entering upon the premises of said school shall observe all posted signs and road markings.
(b) 
Parking shall be permitted in the designated areas and shall be prohibited along the curb areas at all times.
(3) 
Regulations for Lincoln Avenue Elementary School.
(a) 
All vehicles entering upon the premises of said school shall observe all posted signs and road markings.
(b) 
Parking shall be only in the designated areas.
(4) 
Regulations for Nauraushaun Elementary School.
(a) 
All vehicles entering upon the premises of said school shall observe all posted signs and road markings.
(b) 
Parking shall only be in designated areas.
(c) 
During the hours of 7:30 a.m. to 4:00 p.m. on days when school is in session, one-way traffic shall proceed as follows: All traffic shall enter via the westerly entrance of the bus loop and then shall exit via the easterly end of the loop onto Orangeburg Road.
(5) 
Regulations for the premises of the Pearl River Middle School.
(a) 
All vehicles entering upon the premises of said school shall observe all posted signs and road markings.
(b) 
Parking shall only be in the designated area.
(c) 
All vehicles must move in a counterclockwise fashion as indicated by posted signs and roadway markings through the loop in front of the school, except at such times as the bus loop is barricaded off for noontime activities.
(6) 
Regulations for the premises of the Pearl River High School.
(a) 
All vehicles entering upon the premises of said school shall observe all posted signs and road markings.
(b) 
Parking shall be permitted only in the designated areas.
(c) 
Traffic entering the premises from East Central Avenue shall proceed in the manner designated by road markings and shall specifically observe the two sets of stop signs posted on the pedestrian walkways.
(d) 
Vehicles entering from the Holt Drive extension shall observe the roadway markings and posted signs for traffic control.
(e) 
Parking at the high school shall occur only in the designated areas.
(f) 
Violators of no-parking areas shall be liable for police action.
(g) 
Parking shall be prohibited after 5:30 p.m., except on evenings of school activities.
(7) 
Regulations for Administration Building.
(a) 
All vehicles entering upon the premises of said Administration Building shall observe all posted signs and road markings.
(b) 
Entrance to the parking lot shall be from the easterly entrance and all traffic shall exit from the westerly exit.
(c) 
Parking shall be limited to employees and visitors having official business in the Pearl River School District.

A. 
The Superintendent of Schools shall be responsible for establishing appropriate regulations, rules and procedures for the control and regulation of traffic on school grounds in accordance with Article 42, § 1670, of the New York State Vehicle and Traffic Law.
B. 
No motorized vehicle of any kind shall be permitted on any premises of the South Orangetown School District unless such motorized vehicle is operated by a person duly licensed under the motor vehicle laws of the State of New York.
C. 
Without limiting the generality of the phrase "motorized vehicles," it shall include minibikes, buckboards, go-carts, riding lawn mowers, motorcycles, motorbikes, trail bikes, motorized scooters and any and all motor-powered vehicles and all variations thereof, including those that are home-constructed entirely or in part.
D. 
All school premises.
(1) 
All Articles and sections of the New York State Vehicle and Traffic Law shall apply to any and all premises of the South Orangetown Central School District.
(2) 
The Superintendent's regulations following shall apply to the specific locations and premises of the South Orangetown Central School District as hereinafter described:
(a) 
All locations.
[1] 
The maximum allowable speed by any motor vehicle shall not exceed 15 miles per hour, nor shall it exceed 10 miles per hour during the school hours of 7:30 a.m. to 4:00 p.m. on days when school is in session.
[2] 
Parking regulations shall apply between the hours of 7:30 a.m. and 4:00 p.m. on days when school is in session.
[3] 
All fire zones shall be kept free of any vehicles other than fire-fighting apparatus.
(b) 
Regulations for the Blauvelt Cottage Lane Elementary School.
[1] 
All vehicles entering upon the premises of said school shall observe all posted signs and road markings.
[2] 
Parking shall be only in the designated areas.
[3] 
Only one-way traffic (west) shall be permitted on the roadway leading from the westerly exit of the parking area to the easterly side of the roadway's intersection with Western Highway.
(c) 
Regulations for the premises of the Orangeburg Elementary School.
[1] 
All vehicles entering upon the premises of said school shall observe all posted signs and roadway markings.
[2] 
Parking shall be only in the designated areas.
[3] 
During the hours of 7:30 a.m. to 4:00 p.m. on days when school is in session, one-way traffic shall proceed as follows: All traffic shall enter via the easterly entrance and then shall proceed north to the parking area, then westerly to the exit lane to Orangeburg Road, then southerly to the intersection of the school's roadway and Orangeburg Road.
(d) 
Regulations for the premises of the Palisades Elementary School.
[1] 
All vehicles entering upon the premises of said school shall observe all posted signs and roadway markings.
[2] 
Parking shall be only in the designated areas.
(e) 
Regulations for the premises of the Tappan Elementary School.
[1] 
All vehicles entering upon the premises of said school shall observe all posted signs and roadway markings.
[2] 
Parking shall be only in the designated areas.
(f) 
Regulations for the premises of the Tappan Zee Elementary School (Route 9W in the Village of Piermont).
[1] 
All vehicles entering upon the premises of said school shall observe all posted signs and roadway markings.
[2] 
Parking shall be only in the designated areas.
(g) 
Regulations for the premises of the William O. Schaefer Elementary School.
[1] 
All vehicles entering upon the premises of said school shall observe all posted signs and roadway markings.
[2] 
Parking shall be only in the designated areas.
[3] 
Entrance to the front driveway shall be from the most northerly entrance off Lester Drive, observing the one-way traffic sign, and all traffic shall exit via the most southerly exit to Lester Drive.
(h) 
Regulations for the premises of the South Orangetown Middle School (Van Wyck Road and Erie Street in Blauvelt).
[1] 
All vehicles entering upon the premises of said school shall observe all posted signs and roadway markings.
[2] 
Parking shall be only in the designated areas.
[3] 
All traffic entering the parking area off Erie Street shall park in the designated areas. The perimeter of the parking area [surrounded on all four sides by curbing], and as set off by a continuous white traffic line, shall be for the sole purpose of loading school buses. All other traffic is prohibited from parking or standing in the area between the curb and the white traffic line.
[4] 
All traffic entering from Van Wyck Road to the front of the building shall enter via the most southerly entrance to the area, proceeding in a one-way direction, and shall exit via the northerly intersection of the driveway and Van Wyck Road. The traffic lane nearest the sidewalk shall be used for loading and unloading school buses or emergency vehicles, i.e., fire apparatus, police cars and ambulances. The traffic lane to the left of the double white traffic line shall be used by all other vehicle traffic.
(i) 
Regulations for the premises of the Tappan Zee High School (Dutch Hill Road and Bataan Road in Orangeburg).
[1] 
All vehicles entering upon the premises of said school shall observe all posted signs and roadway markings.
[2] 
Parking shall be only in the designated areas.
[3] 
Vehicles entering the south parking area from Dutch Hill Road shall proceed in an easterly direction as indicated by arrows painted on the roadway. Parking shall be in herringbone fashion as provided for by white parking lines painted on the blacktop surface.
[4] 
All vehicles shall enter the parking places as indicated in such a manner that any part of the vehicle shall not extend beyond the white hash mark into the roadway.
[5] 
Vehicles entering the front oval of the Tappan Zee High School shall do so via the most southerly entrance off Dutch Hill Road and shall proceed northerly in a one-way direction and exit at the northerly intersection of the front oval roadway and Dutch Hill Road. The right-hand lane, adjacent to the sidewalk, shall be used solely by emergency vehicles (fire, police and ambulance) and by school buses loading or unloading pupils. No other vehicles shall be permitted in the right-hand lane. All other vehicles shall use the traffic lane to the left of the double white traffic lane.
[6] 
Between the hours of 7:00 a.m. and 4:00 p.m. on days when school is in session, vehicles entering the north parking area from Battaan Road shall be permitted to park along the easterly curb in the parking lanes as indicated. Only authorized school vehicles and delivery trucks shall be permitted beyond the gates adjacent to the gas pump.
(j) 
Regulations for the premises of the District Office Building (10 Western Highway, Orangeburg).
[1] 
Traffic shall proceed in a northerly direction (one-way) from the point at which the south end of the building visually intersects the front driveway and parking area.
[2] 
All vehicles using the driveway behind the building shall proceed in a one-way direction, south.
E. 
The Superintendent of Schools or his designee shall have any vehicle, when improperly parked in parking lanes, fields or driveways of facilities of the South Orangetown Central School District, removed from the area. The expense for such removal and/or storage shall be paid by the owner or operator of any such vehicle prior to the surrender by the school authorities of said vehicle to the owner or operator.

A. 
The following regulations shall apply to the parking lot maintained by the Town of Orangetown located at the former Greenbush School:
(1) 
All parking on the extreme south side abutting the property of Pizza Auto should be designated as diagonal parking.
(2) 
No Parking shall be established along the northern boundary of the property along the entire length of the fence.
(3) 
No Parking shall be established in front of the north entrance.
(4) 
Three parking spaces between the building and Greenbush Road shall be angle parking spaces.
(5) 
The paved portion to the north end of the property line along and against the building is hereby designated a fire lane.

The following areas are to be designated road test areas, and any practice driving is prohibited:
A. 
The area bounded on the north by Orangeburg Road, on the south by Palisades Interstate Parkway, on the east by Route 303 and on the west by Palisades Interstate Parkway.
B. 
The east side of Dutch Hill Road in Orangeburg 300 feet south of the intersection of Orangeburg Road to the intersection of Highview Avenue shall be designated as "Road Test Parking Only."

A. 
The driver of a vehicle upon a public highway, street or private road upon meeting or overtaking from either direction any school bus marked and equipped, as provided in § 375, Subdivision 20, of New York State Vehicle and Traffic Law, which has stopped on the public highway, street or private road for the purpose of receiving or discharging any passengers, or which has stopped because a school bus in front of it has stopped to receive or discharge any passengers, shall stop the vehicle before reaching such school bus when there is in operation on said school bus a red visual signal as specified in Subdivision 20 of § 375 of the New York State Vehicle and Traffic Law, and said driver shall not proceed until such school bus resumes in motion or until signaled by the driver or police officer to proceed.
B. 
The driver of such school bus, when receiving or discharging passengers who must cross a public highway, street or private road, shall instruct such passengers to cross in front of the bus, and the driver thereof shall keep such school bus halted with red signal lights flashing until such passengers have reached the opposite side of such highway, street or private road. Whether such passengers are crossing such highway, street or private road or discharging to the same side of such highway, street or private road, the driver of such bus shall keep such school bus halted with red signal lights flashing until such passengers are at least 15 feet from the bus and either off the highway, street or private road or on a sidewalk.
C. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
PASSENGERS
Those persons designated in Subdivision 20(d) of § 375 of the New York State Vehicle and Traffic Law.
PUBLIC HIGHWAY
(1) 
Any highway, road, avenue, alley, public place, public driveway or any other public way; and
(2) 
Area used for the parking of motor vehicles or used as a driveway located on the ground of a school or of a board of cooperative education service facility or any area used as a means of access to and egress from such school facility.
D. 
Penalties and fines. Every person convicted of a violation of this section shall:
(1) 
For a first conviction thereof, be punished by a fine of not less that $150 nor more than $250 or by imprisonment for not more than 30 days, or by both such fine and imprisonment.
(2) 
For conviction of a second violation, both of which were committed within a period of three years, such person shall be punished by a fine of not less than $600 nor more than $750 or by imprisonment for not more than 180 days, or by both such fine and imprisonment.
(3) 
Upon a conviction of a third or subsequent violation, all of which were committed within a period of three years, such person shall be punished by a fine of not less than $750 nor more than $850 or by imprisonment for not more than 180 days, or by both such fine and imprisonment.

Notwithstanding the provisions of Subdivision (b) of § 1234 of the Vehicle and Traffic Law of the State of New York, persons riding bicycles or skating or gliding on in-line skates upon any public street within the Town of Orangetown shall not ride more than one abreast and shall ride, skate or glide near the right-hand curb or edge of the roadway or upon a usable right-hand shoulder in such a manner as to prevent undue interference with the flow of traffic except when preparing for a left-hand turn or when necessary to avoid conditions that would make it unsafe to continue along near the right-hand curb or edge. This section shall supersede any provision of the Vehicle and Traffic Law that is inconsistent herewith. All other provisions of such law shall remain in full force and effect. Penalties for violating this section shall be governed by Orangetown Town Code § 39-19.
All words, terms or phrases used herein shall have the meanings as defined in the Vehicle and Traffic Law of the State of New York. If no specific definition is set forth therein, all words shall have their usual meaning in the English language.
All laws, ordinances or regulation, or parts thereof, inconsistent with this law are hereby repealed.

A. 
Any person violating the provisions of § 39-2 herein shall be guilty of an offense against this law, which said offense, upon conviction thereof, shall be punishable by a fine not less than $100 nor to exceed $500 or by imprisonment not to exceed 30 days, or both such fine and imprisonment.
B. 
Any person violating any of the provisions of § 39-5B, (parking in driveways and intersections), § 39-5D, (parking within 15 feet of a fire hydrant), § 39-5I, (special vehicle identification permits), and § 39-5.1 (parking in fire zones) shall be guilty of an offense against this law, which said offense, upon conviction thereof, shall be punishable by a fine not to exceed $100 or by imprisonment of not more than 10 days, or both such fine and imprisonment.
C. 
Any person violating any of the provisions of this law, except as hereinbefore provided in Subsection A or B of this section, shall be guilty of an offense against this law, which said offense, upon conviction thereof, shall be punishable by a fine not less than $100 nor to exceed $250 or by imprisonment of not more than five days, or both such fine and imprisonment.
D. 
Any person violating any of the provisions of this law as hereinbefore provided in Subsections B and C of this section and who, upon conviction, has been found to be a second or multiple offender of that applicable violation within 36 months of the last conviction or convictions shall be punishable by an additional fine which shall be no less than $250 and/or imprisonment of not more than 10 days, or a fine of not more than $300 and/or imprisonment of not more than 20 days.
E. 
There shall be imposed a penalty for failure to comply with a summons issued under the provisions of this law as herein provided in Subsections B and C of this section, except for parking meter violations as follows:
(1) 
Upon the person's failure to appear and plead within seven days after the return date of the summons there shall be imposed a penalty of $20.
(2) 
Every 14 days thereafter upon the person's failure to appear and plead there shall be imposed an additional penalty of $20.
(3) 
The maximum total penalties shall not exceed $250.
(4) 
The office of the Town Justice of the Town of Orangetown, upon the person's failure to pay or plead timely, shall have the right to enter a default judgment and may proceed to execute and collect the same in accordance with law.
F. 
There shall be imposed a penalty for failure to comply with a summons issued under § 39-3 (Prohibition of all-night parking) as follows:

(1) 
For a first offense within a calendar year: $10.
(2) 
For a second offense within a calendar year: $25.
(3) 
For a third and subsequent offenses within a calendar year: $50.
If any section or provision of this law shall be adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall not affect the validity of this law as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
