This chapter shall be known and may be cited as the "Adequate
Public Facilities Ordinance of the Town of Smithsburg."
It is the purpose of the Town of Smithsburg that public facilities
and services needed to support new development shall be available
concurrently with the impacts of such new developments. In meeting
this purpose, public facility and service availability shall be deemed
sufficient if the public facilities and services for new development
are phased, or the new development is phased, so that the public facilities
and those related services which are deemed necessary by the local
government to operate the facilities necessitated by that new development
are available concurrently with the impacts of the new development.
