[HISTORY: Adopted by the Mayor and Council of the Town of
Smithsburg 2-3-2004 as Ch. 10 of the 2004 Code. Amendments noted where applicable.]
The Mayor and Council have determined it to be in the best interest
of the residents and citizens of the community and in the interest
of protecting the public health and safety and/or the more efficient
operation of governmental operations and uniformity to provide for
the enforcement by the county of certain county ordinances otherwise
not applicable within the Town and/or for the enforcement by the county
of certain Town ordinances.
The Charter of the Town of Smithsburg and § 4-111
of the Local Government Article of the Annotated Code of Maryland
authorize the Mayor and Council of Smithsburg as a municipal corporation
to establish certain minimum codes as set forth and to authorize,
request and designate Washington County to enforce and administer
such codes if it so desires.

The following
are county ordinances which have been adopted and are considered to
be in force in the corporate limits of the Town of Smithsburg, a municipal
corporation, enforcement to be by the county:
(1)Â
The county ordinance regulating stormwater management, as amended,
supplemented or replaced from time to time, by whatever name it may
be known.
(2)Â
The county ordinance regulating forest conservation, as amended,
supplemented or replaced from time to time, by whatever name it may
be known.
(4)Â
The county ordinance regulating floodplain management, as amended,
supplemented or replaced from time to time, by whatever name it may
be known.
B.Â
The effective
date of all such amendments, supplements and replacements shall be
the same effective date as the same have for enforcement within Washington
County, Maryland, but outside of any municipality. For the purposes
of this section, the terms "amendments," "supplements" and "replacements"
include any transition ordinances or provisions adopted by the county.
The following are Town ordinances that it has adopted and are
considered to be in force in the corporate limits of the Town of Smithsburg,
a municipal corporation, enforcement thereof to be by the appropriate
county authorities by agreement between the Town and the county:

The following are county ordinances that have been adopted and
are considered to be in force in the corporate limits of the Town
of Smithsburg, a municipal corporation, enforcement to be by the Town:
A.Â
That portion of the Adequate Public Facilities Ordinance for Washington
County, Maryland, in effect on July 1, 2005, as amended by the county
from time to time, to the extent that the Adequate Public Facilities
Ordinance contains school adequacy tests, which portion of the Adequate
Public Facilities Ordinance for Washington County, Maryland, as amended
by the county from time to time, is hereby made applicable within
the Town.
