The Town Board of the Town of Orangetown, which is a suburban
Town under the provisions of Article 3A of the Town Law of the State
of New York, takes cognizance of the fact that the Town of Orangetown
now maintains and operates a Department of Public Works which does
not currently fulfill its full potential and has not become fully
responsible to the Town Board of the Town of Orangetown. The concept
of interchangeability of personnel and equipment was never fully achieved.
In order to assure a more efficient management, the Department of
Public Works is abolished and in its place three units are created.
The chief administrative officer of each unit will be under the direct
control of the Town Board of the Town of Orangetown.

There is hereby established in the Town of Orangetown, pursuant
to the Suburban Town Law of the State of New York, a department of
Town government known as the "Department of Highways," and the functions
and personnel of the Town of Orangetown Division of Highways are hereby
transferred to the Department of Highways. All employees, except the
Superintendent will be in the classified civil service.

The executive head of the Department shall be the Superintendent
of Highways which shall be an elective office. The Town Superintendent
of Highways shall be elected pursuant to Town Law, State of New York
Section 20, subdivision 6(b) at the succeeding biennial Town election
in 1997 for a two-year term beginning on the first day of January
1998. The Superintendent shall be elected at each succeeding biennial
Town election thereafter for a two-year term. The Superintendent's
term of office shall begin on the first day of January next succeeding
such biennial election. The term of office of the appointive Town
Superintendent for whom such successor shall be elected shall expire
on the first day of January 1998.

The Superintendent shall be responsible for the supervision
and maintenance of all streets, roads, sidewalks, curbs, utilities
and drainage thereof, as well as parkways. If and when established
by the Town as Town functions, this Department shall also have charge
of the collection and disposal of garbage and refuse. The Department
shall be responsible for the care and maintenance of all motor vehicles,
trucks and other equipment of this Department. The Superintendent
shall hire all Department personnel in accordance with the Civil Service
Law and shall maintain attendance records for all Department employees.

There is hereby established in the Town of Orangetown, pursuant
to the Suburban Town Law[1] of the State of New York, a department of Town government
known as the Department of Environmental Management and Engineering
of the Town of Orangetown, and the functions and personnel of the
Orangetown Sewer Division are hereby transferred to the Department
of Environmental Management and Engineering.

A.
The administrative head of the Department of Environmental
Management and Engineering shall be the Commissioner of Environmental
Management and Engineering, hereinafter referred to as the "Commissioner."
The Commissioner, who shall be appointed by the Town Board of the
Town of Orangetown, shall be in the unclassified civil service. The
Commissioner shall be a graduate of an approved college or university
with a degree in engineering. He shall be a licensed professional
engineer of the State of New York or shall have an advanced degree
in engineering or a relevant engineering subspecialty. He shall have
at least 10 years' experience in an administrative/management
capacity in either the private sector or in Town, county or state
government operations, which includes the supervision of 20 or more
employees.
B.
Subject to the appropriations made for the Department of
Environmental Management and Engineering by the Town Board, and to
all other applicable provisions of law, the Commissioner of the Department
of Environmental Management and Engineering shall have the sole power
to appoint and remove all employees of the Department.

The person holding the office of Director of the Environmental
Management and Engineering Department need not be a resident or an
elector of the Town of Orangetown or of the State of New York.

The Director shall:
A.
Be responsible for the supervision and administration of
the Department of Environmental Management and Engineering.
B.
Review, make recommendations and approve, where necessary,
the public or private work conducted within the Town of Orangetown
as it may affect landfills and excavations, shade trees, pollution,
drainage and sewage, including engineering and architectural work.
C.
Act as consultant to the Town Board, Planning Board and
Board of Appeals, in matters relating to the environment.
D.
Act as liaison for the Town with federal, state and county
agencies, such as the United States Environmental Protection Agency,
United States Department of Agriculture (Soil Conservation Services),
New York State Department of Environmental Conservation, Rockland
County Department of Health and the Rockland Drainage Agency.
E.
Supervise the operation and control of all sewage plants,
pumping stations and maintenance of lateral and trunk sanitary and
storm sewers.
F.
Supervise the design and inspection of the construction
and reconstruction of sanitary sewers within the Town of Orangetown
to ensure that all Town specifications are enforced.
G.
Supervise maintenance work, prepare maintenance schedules
and maintain attendance records of all Sewer Division employees.
H.
Investigate complaints relative to the operation of this
Division, prepare reports and conduct meetings with engineers, inspectors,
contractors and other interested parties relative to the correction
of complaints.
I.
Be responsible for the care and maintenance of all motor
vehicles and other equipment of the Town except motor vehicles and
equipment maintained by the Department of Highways, and the Division
of Parks, Recreation and Buildings.
J.
Be responsible for all designs, construction or reconstruction
of any department facility, unless specific direction to the contrary
is made by the Town Board.
K.
Be responsible for the design, construction or extension
of any pavement or roads and any appurtenances thereto, including
engineering services, as required, or as directed by the Town Board.
L.
Be responsible for the construction, renovation and expansion
of all publicly owned buildings, public parks, playgrounds, athletic
fields and the municipal golf course.
A.
There is hereby created in the Town of Orangetown, pursuant
to the Suburban Town Law of the State of New York, a division of Town
government to be known as the "Division of Parks, Recreation and Buildings."
The functions and personnel of the present Town of Orangetown Division
of Parks and Recreation and the present Division of Building Maintenance
are hereby transferred to the Division of Parks, Recreation and Buildings.
All employees in this Division shall be in the classified civil service.
B.
The head of the Division of Parks, Recreation and Buildings
shall be appointed by the Town Board and such office shall be in the
classified civil service, and the Director will be under the direct
supervision of the Town Board. The title of the head of the Division
shall be Director of Parks, Recreation and Buildings.

The Director shall be responsible for the construction, repair
and maintenance of all public parks, playgrounds, athletic fields,
the municipal golf course and all publicly owned buildings used in
conjunction with public parks, playgrounds, athletic fields and the
municipal golf course. All construction, repair and maintenance of
these facilities shall be done under the direction of the Director,
unless specific direction to the contrary is made by the Town Board.
The Director will maintain attendance records of all employees in
the Division.

All public contracts for projects to be performed by the Superintendent
of Highways, the Director of Environmental Management and Engineering
or the Director of Parks, Recreation and Buildings shall continue
to be provided for as in Article 5-A of the General Municipal Law
of the State of New York as it now exists or may from time to time
hereafter be amended. All public works contracts and all purchase
contracts shall be awarded after public bidding by the Town Board
on the recommendation of the unit head whose unit is affected. The
Supervisor of the Town, the Town Clerk and the affected unit head
shall sign all public works contracts. Nothing herein contained shall
be construed so as to permit the awarding of any public works contracts
or of any purchase contracts or for the purchase of any supplies and
equipment for which an appropriation has not been made by the Town
Board, or which is beyond the funds appropriated by the Town Board
for any of the divisions herein.
The invalidity of any section, clause, sentence or provision
of this local law shall not affect the validity of any other part
of the local law which can be given effect without such invalid part
or parts.
This local law shall take effect upon publishing and posting
and upon filing a copy with the Secretary of State as required by
law.
