The Town Board of the Town of Orangetown finds it necessary to provide more effective coordination among the various boards and agencies of the Town of Orangetown which are concerned with planned and zoning matters. By reason of the large number of boards and agencies of the Town which are involved in these activities and by reason of the need to coordinate into one department the overall servicing of these boards and agencies, a special department of Town government is created to accomplish that purpose.
There is hereby created in the Town of Orangetown, Rockland County, New York, a department of Town government to be known as the "Department of Planning Services."

The Department of Planning Services shall act as the administrative agency for and coordinate the functions of the Planning Board, the Zoning Board of Appeals, the Architecture and Community Appearance Board of Review, the Shade Tree Commission, the Historical Areas Board of Review, the Citizens' Zoning Advisory Committee and such other boards, agencies and advisory committees as may hereinafter be created by the Town Board dealing with planning and zoning in the Town of Orangetown.
The Town Board shall appoint the head of the Department of Planning Services and also shall appoint such deputy department heads as from time to time may be necessary to properly conduct the affairs of this Department. Such deputy department heads shall have power to act generally for and in place of the department head. The department head shall be the principal executive officer of this Department and his office shall be in the unclassified service. The title of the department head shall be the Chief Clerk of the Department of Planning Services. Such deputies as may be appointed shall be in the exempt class of civil service. All other personnel employed in this Department shall be in the competitive classified civil service. Nothing herein contained shall be construed so as to prevent the Town Board from appointing as a department head or deputy department head a person in the classified service. If so appointed, such person shall perform the duties of department head or deputy in such Department in addition to the duties of his or her employment in the classified service.
The head of the Department of Planning Services and the deputy department head shall hold office until the first day of January next succeeding the first biannual Town election held after their appointment, and thereafter shall hold office for the term of two years and until their successors have qualified; provided, however, that the appointees to such office shall be removable at the pleasure of the Town Board.

The Chief Clerk of the Department of Planning Services shall also act as the Clerk of the Planning Board, the Zoning Board of Appeals, the Architecture and Community Appearance Board of Review, the Historical Areas Board of Review, the Shade Tree Commission, the Citizens' Zoning Advisory Committee and such other boards, agencies or advisory committees as may hereinafter be created by the Town Board dealing with planning and zoning activities in the Town of Orangetown. The deputy department heads shall be deputy clerks of the foregoing boards and agencies and advisory committees.
The salaries of the department head, the deputy department head and all employees of this Department shall be determined in the same manner as is provided in the annual budget for the salaries of other Town officers and employees; provided, however, that where the duties of the Department are increased, altered or diminished by local law and to the extent funds are available therefor, appropriate adjustments may be made in such local law in the salary of such department head, deputy department head or other employees.
This local law shall take effect immediately.
