A. 
A person may not use or sell consumer fireworks, as defined in 8 M.R.S.A. § 221-A, in the Town or in or from any watercraft within waters of the Town, except that the use of consumer fireworks shall be permitted pursuant to the state statute effective on January 1, 2012, on the following days and during the following times:
(1) 
July 3 beginning at 9:00 a.m. and ending at 10:00 p.m.;
(2) 
July 4 beginning at 9:00 a.m. and ending at 12:30 a.m. on July 5;
(3) 
July 5 beginning at 9:00 a.m. and ending at 10:00 p.m.;
(4) 
December 31 beginning at 9:00 a.m. and ending on January 1 at 12:30 a.m.; and
(5) 
January 1 beginning at 9:00 a.m. and ending at 10:00 p.m.
B. 
Pursuant to 8 M.R.S.A. § 227-B, nothing in this section shall be construed to limit or regulate fireworks displays, as defined in 8 M.R.S.A. § 221-A, or the issuance of permits for fireworks displays by the Maine Commissioner of Public Safety or a designee.
It is a civil violation for any person to use or sell consumer fireworks within the Town of Cumberland in violation of this chapter, and any person found to have violated the chapter shall be punished by a fine of $200.
