The provisions of this Ordinance shall be enforced by the zoning officer with the aid of the police department and other municipal agents and agencies. He shall examine all applications for permits, issue permits only for construction and uses which are in accordance with the requirements of this Ordinance, record and file all applications for permits with any accompanying plans and documents, which shall be matters of public record, and make such reports as the township council may require. Permits for construction and uses which are a special exception or a variance from the requirements of this Ordinance shall be issued only upon order of the zoning hearing board. The zoning officer shall be authorized to institute civil enforcement proceedings as a means of enforcement of the provisions of this Ordinance.

A use and occupancy permit shall be required prior to any of the following:
A. 
Use and occupancy of any building or other structure hereafter erected or substantially altered;
B. 
Change in use of any building or structure;
C. 
Use of land or change in the use thereof, except that the placing of vacant land under cultivation shall not require a use and occupancy permit;
D. 
Change in use of nonconforming use.
E. 
Whenever any commercial or industrial building or part of a building changes ownership or tenancy;
F. 
The construction of or placement upon a lot of a shed or garage.
It shall be unlawful for any person to use or occupy any building or other structure or land until a use and occupancy permit has been duly issued therefor.

All applications for use and occupancy permits shall be made in writing on forms furnished by the township and shall include all information necessary to enable the zoning officer to ascertain compliance with this Ordinance.

No use and/or occupancy permit shall be issued until the proposed use complies with existing township ordinances. Pending completion of a building or alteration thereto, a temporary occupancy of a part or all of the building may be permitted, provided that such temporary occupancy would not, in the opinion of the zoning officer, jeopardize life or property. The issuance of a use and/or occupancy permit does not constitute a representation, guarantee or warranty of any kind by the township, or by any official or employee thereof, as to the quality of workmanship involved in the construction or alteration, or as to the design of the structure or alteration, nor shall the issuance thereof create a liability upon the township, its officials or employees.

If the zoning officer determines that an application is in compliance with the provisions of this Ordinance, it shall be his duty to issue the appropriate permit; and if he determines that an application is not in compliance with the provisions of this Ordinance, it shall be his duty to refuse the permit, in which case he shall instruct the applicant in the method of appeal or application to the zoning hearing board.

Whenever an amendment to this Ordinance or Zoning Map shall have been adopted, the township manager shall place such amendment on the agenda of the first public meeting of the township council held eighteen (18) months after the effective date of the amending ordinance at which time the Council shall consider the effect of the amendment.
