WHEREAS, in order to continue to provide for the safety of the
residents of the Town of West New York and to ensure that certain
individuals who are violating the law are paying their debts to the
Town of West New York, a new chapter is being added to the Code of
the Town, entitled "Vehicle Boot Pilot Program":
A new chapter is added to the Town's Code, which shall
be entitled "Vehicle Boot Pilot Program."
A pilot program be and hereby is established through the use
of two vehicle boots which are presently in the possession of the
Town of West New York for the enforcement of penalties and the collection
of fines.
The Town of West New York Director of the Police Department
and/or his designee, shall have the authority, once provided with
sufficient information pertaining to the owner of a vehicle that is
presently in arrears with regard to fines and/or penalties resulting
from conduct that has violated the Code of the Town of West New York
or the laws of the State of New Jersey, to enforce the penalties and
to collect the unpaid funds from the appropriate individual. The use
of the vehicle boot on any vehicle parked on a street in the Town
of West New York be and hereby is permitted with regard to enforcement
and collection of the above.
Upon booting of the vehicle as described above, the owner of
said vehicle shall then be required to make payment in an amount equal
to that outstanding for violations deemed appropriate by a designated
official of the Town of West New York, which shall be in accordance
with the outstanding fines and/or fees, and, at that time, the vehicle
boot may be released.
Said payment may be made in cash or by credit card.
Nothing in this chapter shall preclude the appropriate designated
individual for the Town of West New York to require that the owner
of the vehicle subjected to the vehicle boot appear in court due to
an outstanding warrant, or for other reasons, and to be subject to
the jurisdiction of the Town of West New York Municipal Court."
Should any individual be subject to the jurisdiction of the
Town of West New York Municipal Court, then, in that event, the Municipal
Magistrate shall have the authority vested in him to set bail, which
may be for the same amount of the outstanding debt obligation for
the booted vehicle, and to assign a court date for further hearing
on this or any other matter.
If any section or provision of this chapter shall be held invalid
in any court, the same shall not affect the other sections or provisions
of this chapter except so far as the section or provision so declared
invalid and shall be inseparable for the remainder or portion thereof.
All ordinances or parts of ordinances inconsistent herewith
are hereby repealed to the extent of such inconsistency.
This chapter shall become effective immediately upon final passage
and publication as required by law.
