BICYCLE — A vehicle having two (2) wheels, with
inflated tires having handlebars or a steering wheel and a saddle
seat or other seat and propelled or capable of being propelled, either
wholly or in part, by muscular power.

No person who resides in the Borough of East Lansdowne shall
ride or propel a bicycle on any street unless such bicycle shall have
been licensed and a license plate shall have been attached thereto;
as provided herein.

No person not a resident of the Borough of East Lansdowne; shall
ride or propel a bicycle, ordinarily kept within the limits of the
said Borough; on any street unless such bicycle shall have been licensed
and a license plate shall have been attached thereto; as provided

Any resident of the Borough of East Lansdowne, or any person
who rides or propels a bicycle ordinarily kept within the limits of
the Borough of East Lansdowne, upon the purchasing or acquiring a
bicycle, must immediately apply for a bicycle license; registration
card and license plate within ten (10) days after such purchase or
acquisition. Such application shall be made on a form provided by
the Borough of East Lansdowne.

The registration card and metal tag or license plate issued
pursuant to application for same, shall be permanent as long as ownership
of the bicycle remains unchanged. The license to ride or propel a
bicycle shall be valid until the first day of January of the second
year following its issue. A new operator's license shall be issued
upon application to the Bicycle safety Program Director and after
applicant's bicycle passes inspection.

The Borough of East Lansdowne shall provide permanent metallic
license tags, together with registration cards; which tags and cards
shall have numbers stamped thereon in numerical order, beginning with
Number 1 and indicating the name of the Borough and the year of issue.
Such tags shall be suitable for attachment to the rear mudguard or
the frame of the bicycle for which issued; in such position as to
be plainly visible. Such tag shall be attached to the bicycle by the
Bicycle Safety Program Director or persons designated by said Director
at the time of issuing the license and shall remain attached to the
bicycle for which it is issued for so long as such license shall remain
in effect. Bicycle Safety Program Director, or persons designated
by him, shall also keep a record of such registration. Upon issuance
of a license and attachment to the bicycle, the Bicycle Safety Program
Director, or persons designated by said Director, shall furnish to
the owner of such bicycle the corresponding registration card. The
operator of a bicycle shall display his registration card, or produce
satisfactory proof that the owner has such registration card, upon
demand of any Officer of the Borough of East Lansdowne Police Department.

The Bicycle Safety Program Director, or persons designated by
him, shall inspect each bicycle before licensing the same and shall
refuse a license for any bicycle which he deems to be in an unsafe
condition.

It shall be the duty of every person who sells or transfers
ownership of any bicycle within the Borough of East Lansdowne, to
report such sale to the Bicycle Safety Program Director. If such bicycle
had been licensed and registered, such person shall, at the same time,
return to the Bicycle Safety Program Director the registration card
and license tag. Such person shall furnish the Bicycle Safety Program
Director with the name and address of the person to whom such bicycle
was sold or transferred. Such report and return of the registration
card and license tag shall be made within three (3) days of the date
of said sale or tranafer.

It shall be the duty of every person who dismantles, reduces
to junk, or takes out of operation, any bicycle, whether the same
be registered or not registered; to report the same to the Bicycle
Safety Program Director and to turn in the registration card and license
tag, if such bicycle was registered.

It shall be unlawful for any person willfully or maliciously
to remove; destroy, mutilate or alter the number on any bicycle frame;
or to remove, destroy or alter any license tag or registration card
during the time when such license tag or registration card is valid,
except as provided in § § 108 and 109. If any
bicycle does not have a serial number stamped on the frame thereof,
or if such number is illegible; then the Bicycle Safety Program Director
shall stamp an identification number on the frame of such bicycle.

In case of loss or destruction of any license tag and/or registration
card and/or operator's license, a duplicate tag and/or card shall
be issued to the registered owner of such bicycle, upon payment of
a fee of ten cents (10¢) for each tag or card required; provided
such owner gives satisfactory proof of such ownership and loss or
destruction of such card and/or tag, by affidavit or otherwise, to
the Bicycle Safety Program Director.

If any bicycle shall be found on any street or alley of the
Borough of East Lansdowne without a license tag as herein set forth,
or with a mutilated serial number or no serial number stamped on the
frame of the bicycle, it shall be prima facie evidence that such bicycle
is being operated without proper registration.

It shall be unlawful for any person to operate a bicycle on
any street or public alley in the Borough of East Lansdowne in violation
of any traffic ordinances of the Borough of East Lansdowne which are
applicable to motor vehicles.

It shall be unlawful for any person to operate a bicycle upon
any sidewalk in a business district or place of public gathering in
the Borough of East Lansdowne.

The following provisions shall pertain to bicycles and bicycle
riding within the Borough of East Lansdowne:
A.
Every person propelling or riding a bicycle upon a public thoroughfare
shall be subject to the provisions of all ordinances and State laws
applicable to the operator of any vehicle, except those provisions
which by their nature would have no application or where otherwise
expressly provided.
B.
No bicycle shall be operated upon any pedestrian occupied public
sidewalks or upon any occupied pedestrian paths.
C.
No person operating a bicycle upon a thoroughfare shall participate
in any race or speed or contest with any other vehicle.
D.
No rider of a bicycle shall remove both hands from the handlebars
or feet from the pedals or practice any acrobatic or fancy riding
on any public thoroughfare.
E.
No bicycle shall be parked upon the sidewalks in such a manner as
to interfere with the access to the doorway or entrance to a building
or in such a manner as to interfere with the free and uninterrupted
flow of pedestrian traffic.
F.
No bicycle shall have more than one (1) rider per seat.
G.
No person operating or riding a bicycle shall sit on the handlebars
or any other bicycle part other than the designated seat.

No person shall operate a bicycle upon any street unless such
bicycle is equipped with a bell or other device capable of giving
a signal audible for at least one hundred (100) feet, except that
no bicycle shall be equipped with; nor shall any person use upon a
bicycle, any siren or whistle.

It shall be unlawful for any person to operate a bicycle upon
any street in such a manner as to interfere with any pedestrian who
is exercising due care thereon.

It shall be unlawful for any person to operate a bicycle upon
any street in the Borough of East Lansdowne by propelling such bicycle
abreast of any other persons so propelling a bicycle, except in passing
such bicycle.

The operator of a bicycle emerging from an alley, driveway or
building, shall, upon approaching the sidewalk or sidewalk area extending
across any alleyway, yield the right-of-way to all pedestrians approaching
on said sidewalk or sidewalk area, and, upon entering the roadway,
shall yield the right-of-way to all vehicles approaching on said roadway.

When necessary to park bicycles on a street or sidewalk, bicycles
must be parked in an upright position and in a manner not to obstruct
pedestrian or vehicular traffic.

Any person who shall violate any provisions of this Part shall,
upon determination by the Bicycle Safety Program Director, have his
operator's license revoked for a period of not to exceed seven
(7) days.

1.
For the initiation of the Bicycle Safety Program in the Borough of
East Lansdowne and for the carrying out and enforcing the provisions
of this Part; there is created hereby the Office of Bicycle Safety
Program Director.
2.
The Director shall be appointed by the Police Chief and shall serve
a term of office for a period of one (1) year.
3.
The Director shall serve on a voluntary basis and shall be entitled
to no salary or compensation for his services.

Any person who violates any provision of this Part shall, upon
conviction, be sentenced to pay a fine of twenty-five dollars ($25.00)
and costs.
