It is unlawful and prohibited for any person, firm or corporation to collect, pickup or remove combustible materials by or from stores, apartments or office buildings, factories or other commercial or manufacturing establishments, unless and until a license has been obtained from the Borough as hereinafter set forth.

Application shall be made in form to be supplied by the Borough and shall be issued by the Secretary upon the approval of collector's application and payment of the license fee. The license shall be in a form prepared by the Borough Secretary and shall bear a number.

The collector's license number shall be displayed on the side of the collector's truck.

No person shall be licensed as a collector unless he provides a truck in which the combustible and waste materials may be placed in a manner to prevent its being scattered, blown away or dispersed. Any truck used by a collector shall be first exhibited to the Chief of Police or an officer designated by him for inspection.

All licenses issued hereunder are personal and are not transferable. The use of a license by a person other than the licensee shall cause the license to be revoked.

The license fee shall be $100 for a calendar year. If a license is issued during the year, the license fee shall be prorated.

No collector of combustible and waste materials shall operate after sunset or before sunrise, and in no event before 7:00 a.m. or after 7:00 p.m.

Every collector, upon demand of a police officer, in uniform, shall permit an examination of the contents of his vehicle or of any receptacles therein.

Before any license shall be issued as aforesaid, the collector shall exhibit to the Borough Secretary proof that he carries property damage insurance up to $5,000 and public liability insurance in the amount of $20,000 to $40,000.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 plus costs, and in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Every day that a violation of this Part continues shall constitute a separate offense.
