A. 
Applicability. The regulations set forth in this section or set forth elsewhere in this chapter and referred to in this section are the district regulations for the IND District.
B. 
Permitted uses. All buildings or premises in the IND District shall be used only for the following purposes:
(1) 
Industrial and light industrial uses, including manufacturing, assembling, processing and warehousing which meet the performance standards contained in Article XXIX (§§ 51-183 through 51-199).
(2) 
Dwelling quarters for a caretaker or watchman.
(3) 
High technology facilities.
(4) 
Laboratory testing and research facilities in the biotech, pharmaceutical and similar type industries, provided no hazardous materials, liquids or gases are used or produced in such a facility.
(5) 
"Green collar" industrial uses, such as those researching, producing, distributing or selling clean energy products.
(6) 
Warehouses.
(7) 
Senior housing for persons at least 62 years of age and related facilities.
(8) 
Any use permitted in the C-1 Neighborhood Commercial District.
(9) 
Assembly of dry goods or nonperishable items.
(10) 
Food processing, storage or distribution.
(11) 
Laundry facility, wholesale or retail.
(12) 
Automobile parts sales (inside retail store only).
C. 
Conditional uses. In the IND District, the following uses shall be permitted conditional uses, subject to the approval of the Planning Board and subject to the standards contained in Article XXIII (§ 51-118) of this chapter:
(1) 
Retail sales of a factory outlet nature.
(2) 
Commercial parking lots and structures.
(3) 
Accessory parking lots or garages located on a lot other than the location which the principal use is located but no further than 200 feet from the principal use, except where shared parking is provided pursuant to § 51-162.
(4) 
Supermarkets.
(5) 
Public utility installations.
(6) 
Personal wireless telecommunications facilities.
(7) 
Billboards.
(8) 
Auto repair garages, body shops and auto painting.
(9) 
Colleges and universities.[1]

D. 
Accessory uses. The following accessory uses shall be permitted within the IND District:
(1) 
Parking garages.
(2) 
Parking lots.
E. 
Prohibited uses. No building or premises in the IND District shall be used for any purposes not specifically permitted or conditionally permitted. Additionally, the following uses are also expressly prohibited:
(1) 
No building or premises shall be used and no building shall be erected or structurally altered for any dwelling purpose, except that dwelling quarters may be established in connection with any industrial establishment for necessary watchmen or caretakers employed upon the premises.
(2) 
No building or part thereof designed and built for storefront-type retail use or residential use may be used as a house of worship, club or charitable or philanthropic institution.
(3) 
Any use involving outdoor storage, outdoor product processing, or substantial outdoor waste disposal.
(4) 
Drive-through establishments, including but not limited to retail, banking or auto establishments with drive-through service.
(5) 
Business or vocational schools.
(6) 
Sexually oriented businesses.
(7) 
Bars, nightclubs and dance halls without noise-mitigation measures that comply with state and local standards (65 decibels at property line).
(8) 
Massage facilities/massage parlors.
(9) 
Restaurants that are takeout only.
(10) 
Through-window retail or restaurant.
(11) 
Outdoor storage.
(12) 
Automobile alarm, stereo installation.
(13) 
Check cashing establishment not within bank, pharmacy or grocery store.
(14) 
Bail/bonds.
(15) 
Pawn shops.
(16) 
Gun stores and ammunition retailers.
(17) 
Tattoo/body piercing establishments.
(18) 
Computer server housing facility.
(19) 
Lumberyard.
(20) 
Operation facilities for taxicab, bus, ambulance.
(21) 
Taxi/limousine parking staging facilities.
(22) 
Heliport.
(23) 
Kennel, animal boarding/sheltering.
(24) 
Self storage.
(25) 
Truck terminal.
(26) 
Utility (transformer).
(27) 
Vehicle towing facility.
(28) 
Waste transfer station.
(29) 
Materials salvage yards, junkyards, dumps.
(30) 
Facilities that provide congregate living arrangements that provide shelter or lodging for profit or charity, with or without meals, including homeless shelters, rooming houses, hotels without private bathrooms, or halfway houses.
(31) 
Facilities for treating or sheltering people with communicable diseases, not in hospitals.
(32) 
Philanthropic institutions providing social services.
(33) 
Boardinghouse or rooming house.
(34) 
Drug or alcohol treatment facilities.
(35) 
Methadone clinics.
(36) 
Soup kitchens, except as operated by a house of worship on its own property.
(37) 
Nail salons.
(38) 
Hair-braiding establishments.
(39) 
"Dollar stores."

(2) 
The parking and loading requirements for the Industrial District are contained in § 51-164, Off-street parking requirements, and § 51-165, Off-street loading requirements.
(3) 
The sign regulations for the IND District are contained in XXV (§§ 51-166 through 51-170) of this chapter.
(4) 
A screened buffer of at least 25 feet wherever residential uses abut an industrial land use or zone. Fencing and landscaping must be adequate in order to shield the industrial building from the residential structure to the greatest extent possible.

Accessory uses. The following accessory uses shall be permitted:
(1) 
Any accessory use permitted in the C-1 Neighborhood Commercial District.
(2) 
Any accessory use permitted in the IND Industrial District.
E. 
Prohibited uses. The following uses shall be prohibited:
(1) 
Any use prohibited in the IND District.
(2) 
Expansion of or increase in density or intensity of use of existing nonconforming industrial uses.
F. 
Additional requirements.
(1) 
The bulk requirements of the IND-1 District shall be consistent with the bulk requirements of the IND District.
(2) 
The parking and loading requirements for the IND-1 District are contained in § 51-164, Off-street parking requirements, and § 51-165, Off-street loading requirements.
(3) 
The sign regulations shall be consistent with those sign regulations of the IND District, contained in Article XXV (§§ 51-166 through 51-170) of this chapter.
(4)
