There is hereby created and established a Plumbing Board consisting
of five members to be appointed by the Mayor, one whom shall be a
master plumber with 10 years' experience in the business of plumbing
or a licensed or mechanical or civil engineer; one of whom shall be
a journeyman plumber with six years' experience in the business of
plumbing; and three of whom shall be citizens of the City of Poughkeepsie
not engaged in or related to persons engaged in the business of plumbing.
All members of the Plumbing Board shall be citizens and actual residents
of the City of Poughkeepsie. The City Engineer and the Plumbing Inspector
of the City of Poughkeepsie shall be ex officio members of the Board
and shall have no vote on matters before the Board.

Of the members of the Plumbing Board who are first appointed
pursuant to this article, one shall be designated to serve for a term
of one year, two shall be designated to serve for terms of two years
and two shall be designated to serve for terms of three years from
the first day of January following their appointment. Thereafter the
term of office shall be three years.

The Plumbing Board shall have power and it shall be its duty:
(a)
To meet at stated intervals not less frequently than once every month.
They shall also meet whenever the Mayor of the City shall, in writing,
request them so to do. The meeting shall be public.
(b)
To have jurisdiction over and to examine all persons desiring or
intending to engage in the trade, business or calling of plumbing
as employing or master plumber in the City with the power of examining
persons applying for certificates of competency as such employing
or master plumbers or as inspectors of plumbing, to determine their
fitness and qualifications for conducting the business of employing
or master plumbers or to act as inspector of plumbing and to issue
certificates of competency to all such persons who shall have passed
a satisfactory examination before such Board and shall be by it determined
to be qualified for conducting the business as employing or master
plumbers or competent to act as inspectors of plumbing.
(c)
To interpret the standards of the New York State Uniform Fire Prevention
and Building Code applicable to plumbing upon request by the Plumbing
Inspector, upon formal request in accordance with the provisions of
this Code from a person aggrieved by a decision of the Plumbing Inspector
or upon its own motion.
(d)
To charge and collect, from each person applying for examination,
the sum of $250 for each examination made by such Board, which fee
shall be nonrefundable and shall be paid at the time of making his/her
application, and all moneys so collected shall be paid over by the
Board monthly, to the Commissioner of Finance.
(e)
To charge and collect a fee for the issuance of a certificate of
registration to qualify the employing of a master plumber or for the
renewal of such certificate. Any lapse in renewal shall require an
administrative fee in an amount equal to the reapplication fee. The
administrative fee shall be in addition to any fee charge for reapplication.
Prior to expiration, a licensed master plumber may petition the Building
Inspector to suspend his/her license. A master plumber whose license
has been suspended at the master plumber's request may reinstate such
license at any time within five years from the date the license was
scheduled to expire. There shall be a fee plus the license fee to
reinstate a license that has been suspended at the request of the
master plumber.
(f)
To promulgate rules and regulations not inconsistent with this chapter
for the administration of the New York State Uniform Fire Prevention
and Building Code applicable to plumbing.
(g)
To establish a schedule of fees to be collected by the Plumbing Inspector
for plumbing work to be executed in the City. Said schedule of fees
and any changes thereto must be approved and adopted, by resolution,
by the Common Council of the City.
(h)
To create a written examination to be administered to homeowners prior to issuance of a homeowner's first plumbing permit pursuant to Section 6-145 of this chapter. Said examination shall consist of 10 multiple-choice questions to test that a homeowner possesses a general and rudimentary knowledge of plumbing so as to perform plumbing work as permitted by Section 6-145 of this chapter and shall not require the level of technical knowledge and expertise necessary to obtain a certificate of competency so as to be a licensed plumber in the City of Poughkeepsie. The fee for each homeowner's test given shall be $20 and shall be nonrefundable and shall be paid at the time of making the application for the first homeowner's permit.
(i)
To create a written examination to be administered to a person or firm licensed to install heat-producing equipment, pursuant to Section 6-179 of this chapter, desirous of obtaining a special permit for making water connections for installation of heat-producing equipment, as permitted by Section 6-145 of this chapter.
