Editor's Note: This article is superseded by Ord. No.
638, adopted 6-15-2004, by which the Borough elected to administer
and enforce the Pennsylvania Uniform Construction Code, except to
the extent that this article's provisions are more restrictive.
A certain document, three copies of which are on file in the office of the Borough Manager/Secretary of the Borough of Sellersville, being marked and designated as the "BOCA National Building Code, Fourteenth Edition, 1999," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Building Code of the Borough of Sellersville, County of Bucks, in the Commonwealth of Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Building Code are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 58-29 of this article.
All other ordinances or parts of ordinances in conflict herewith
are hereby repealed.
The following sections are hereby revised as follows:
A.Â
Section 101.1. Change to read:
Title: These regulations shall be known as the
Building Code of the Borough of Sellersville, hereinafter referred
to as "this code."

Section 112.3.1. Change to read:
Fee Schedule: A fee for each plan examination,
building permit and inspection shall be paid in accordance with the
schedule of fees established by resolution of the Borough Council.

Violation penalties: Any person who shall violate
a provision of this code or shall fail to comply with any of the requirements
thereof or who shall erect, construct, alter, or repair a building
or structure in violation of an approved plan or directive of the
code officials, or a permit or certificate issued under the provisions
of this code, shall be prosecuted in the same manner provided for
the enforcement of summary offenses under the Pennsylvania Rules of
Criminal Procedure and upon conviction shall be sentenced to pay a
fine not to exceed $1,000 per violation, plus court costs and reasonable
attorneys' fees incurred by the Borough of Sellersville, or to
imprisonment for not more than 90 days, or both. Violations of more
than one provision of this section shall constitute separate violations.
Each day that a violation of any provision of this section continues
or occurs shall constitute a separate violation.

Section 117.2. Change to read:

Unlawful continuance: Any person who shall continue
any work in or about the structure after having been served with a
stop order, except such work as that person is directed to perform
to remove a violation or unsafe condition, shall be prosecuted in
the same manner provided for the enforcement of summary offenses under
the Pennsylvania Rules of Criminal Procedure and upon conviction shall
be sentenced to pay a fine not to exceed $1,000 per violation, plus
court costs and reasonable attorneys' fees incurred by the Borough
of Sellersville, or to imprisonment for not more than 90 days, or
both. Violations of more than one provision of this section shall
constitute separate violations. Each day that a violation of any provision
of this section continues or occurs shall constitute a separate violation.

Section 3408.2 (first paragraph). Change to read:
Applicability: Structures existing prior to September
13, 1999, in which there is work involving additions, alterations,
or changes of occupancy, shall be made to conform to the requirements
of this section or the provisions of Sections 3402.0 through 3407.0.

Nothing in this article or in the building code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 58-28 of this article; nor shall any just or legal right or remedy of any character be lost, impaired, or affected by this article.
