[HISTORY: Adopted by the Town Board of the Town of Elma 11-21-2001. Amendments noted where applicable.]
Restaurants or taverns that wish to play or perform live music must first obtain a license from the Town.
Application for such license shall be made to the Town Board. The Town Board will refer the application to the Building Inspector for his investigation and recommendations. The Town Board will then issue a determination to approve or deny the application based upon the Building Inspector's recommendation, as well as any other information that the Town has concerning the history of the establishment and his investigation of the applicant's other licenses, if any.
Any license granted under this chapter may be suspended, revoked, renewed or refused by the Town Board upon determination after notice and hearing before the Town Board.
The fee for each license shall be reviewed and set from time to time as deemed necessary by the Town Board. Each license shall expire on the 31st day of May next succeeding the date of issuance and must be renewed annually to continue to operate.
