GENERAL REFERENCES

As used in this article, the following terms shall have the meanings indicated:
LIVESTOCK
Defined as but not limited to any number of cows, horses, swine, sheep and fowl of all types.
LIVESTOCK RUNNING AT LARGE
Any livestock not behind a sufficient fence and which is not attended by the owner or his or her representative and which is situated upon any public street, park, or any other public place while unrestrained or situated upon any private property, including the property of the livestock owner, while not restrained by a sufficient fence, enclosure or tether.
A. 
Any person, partnership or corporation which keeps livestock for any purpose within the Township of Hampton is hereby prohibited from permitting said livestock from running at large.
B. 
Fencing requirements. A fence measuring at least four feet high from the surface of the earth and sufficiently enclosed and strong enough to prevent livestock from escaping is hereby required wherever livestock is kept. If any livestock escapes from within the confines of any fence, it shall be presumed that such fence has not met the provisions of this chapter. Any owner or lessee of the land on which such fence is located is subject to the requirements of this section. The owner of every property on which the fence is located shall be responsible for compliance with this ordinance.
The Code Enforcement Officer, the Municipal Health Office and/or the Municipal Construction Official are hereby individually and severally empowered to enforce the provisions of this ordinance.
Any person, corporation, occupant or entity that violates or fails to comply with any provisions of this ordinance shall, upon conviction thereof, be punishable by a fine of not less than $100, or more than $250 for the first offense, by a fine of not less than $250 or more than $500 for the second offense, and by a fine of not less than $500 or more than $1,000 for the third or subsequent offenses. The respective enforcing authority as set forth in § 36-3 may in his or her discretion give a warning for the first offense. Each day for which a violation of this ordinance occurs shall be considered a separate offense.
In the event that it is determined, by a court of competent jurisdiction, that any provision or section of this ordinance is unconstitutional, all other sections and provisions shall remain in effect.
This ordinance shall take effect upon passage and publication according to law.

No hunting of animals of any kind shall be permitted on any Township-owned property, subject only to the following exceptions:
A. 
Although hunting snakes and reptiles on Township-owned property is not permitted, a person who is on Township-owned lands and comes upon a snake known to be deadly poisonous or a deadly reptile is not prohibited by this section from killing same on sight.
B. 
Township-directed pest control on its properties is permitted.
Any person violating a provision of this article shall, on conviction, be subject to the penalties and fines prescribed in Chapter 1 of this Code.
This article is in addition to and not in derogation of any other ordinance involving or affecting any of the subject matters contained in the within article.
