The Mayor shall have power to sell any personal property belonging to the City which in his judgment is not necessary for the proper conduct of its business, subject to the restrictions hereinafter set forth.

If the fair market value of any item or items of property sought to be disposed of by sale under this article does not exceed $1,000, the Mayor may sell the same at private sale without competitive bidding. In such event, the terms of such sale shall be cash, payable to the City Treasurer; and the Mayor shall at the time of the sale furnish to the City Treasurer an itemized list and statement of the transaction, including therein the date of the purchase or acquisition of the property by the City, the cost price to the City thereof, the name of the purchaser and the amount paid therefor by the purchaser. Such reports shall be open to public inspection.

In the event that the fair market value of any item or items of property sought to be disposed of by sale under this article exceeds $1,000, the Mayor shall advertise publicly for bids therefor in a daily newspaper published in the City and shall thereafter either sell the same to the highest bidder or refuse all bids. Each such bid shall be accompanied by a certified check payable to the order of the City Treasurer in the amount of such bid, which such check shall be returned to the bidder in the event that his bid is not accepted. No sale of such property shall be valid unless the provisions of this section are complied with; however, the City Council may, for adequate cause and upon the request of the Mayor, waive the requirements of this section in any particular case.
