The boundary limits of the Borough of Mechanicsburg are hereby
established as a zone in which motor vehicles may remain standing
without lights, and all streets and alleys within such boundary limits
are hereby designated as streets and alleys where motor vehicles may
remain standing without lights.

1.
Wherever a particular parking space shall be lined or marked off
on any street or alley or upon the adjacent curb, every vehicle parked
shall be parked within the lines marking such parking space; and all
vehicles parked on streets or alleys within the Borough of Mechanicsburg
whether parking spaces are marked or not shall be parked only in the
direction of the permitted traffic flow.
2.
Parking shall be prohibited at all times in any manner by any vehicle
which in any way will block the intersection of any street with another
street, any intersection of a street with any alley; so as to block
the entrance or exit from any alley; at any point within the painted
line area adjacent to any fire hydrant; at any point within the painted
line area marking the permissible distance to park from any intersection;
in any area where erected signs or painted lines indicate a "no parking"
area; in any manner so as to block any public driveway or access way
to a parking lot or parking facility or other facility of the Borough
of Mechanicsburg; or so as to block any private driveway within the
Borough of Mechanicsburg

Reserved on-street handicapped parking for persons with disabilities
or severely disabled veterans is hereby established in the Borough
of Mechanicsburg.
A.
Application Required.
(1)
Any disabled person or severely disabled veteran requesting
an on-street reserved handicapped parking space at applicant's
place of residence within the Borough shall make application with
the Borough per a form approved by Council and pay all required fees.
(2)
All disabled persons or severely disabled veterans having a
designated on-street reserved handicapped parking space within the
Borough on or before the enacting date of this section shall make
application for renewal of the designated on-street parking space
to the Borough within 60 days of the passage of this section, or upon
notice by the Borough, and pay all required fees.
B.
Review of Applications. The Borough's Codes/Zoning Officer,
Police Department and Highway Department shall review all applications
submitted and shall make a recommendation to Borough Council as to
approval and/or designated location of handicapped parking space.
Council shall take action upon all applications by way of resolution.
C.
Criteria for Parking Space. The criteria for consideration for a
parking space pursuant to this section are as follows:
(1)
The applicant must possess a current disabled state-issued license
plate or placard or a current severely disabled veteran state-issued
license plate or placard.
(2)
Applications will only be considered for reserved handicapped
parking on a public street or roadway. The Borough will not consider
any application for a handicapped parking space on any private property.
(3)
The Borough may require the applicant to appear before Borough
Council at a regular or special meeting of Council at which the handicapped
parking request will be considered. Failure to appear may be grounds
to reject or deny the application.
(4)
No reserved parking space will be granted where an off-street
parking area, driveway, lot, garage and/or carport currently exists
at the applicant's residence and is reasonably accessible by
the applicant.
(5)
No reserved parking space will be granted if the applicant does
not have current and permanent mobility issues, unless extraordinary
circumstances exist.
(6)
No reserved parking space will be granted if the applicant no
longer drives on a regular basis, unless extraordinary circumstances
exist.
(7)
No reserved parking space will be granted if the applicant does
not reside full-time at the address on the application.
(8)
No reserved parking space will be granted if the vehicle in
the application is not registered to the address on the application.
(9)
No reserved parking space will be granted in areas where current
parking restrictions, existing laws or ordinances prohibit parking.
(10)
All other criteria established by resolution of Borough Council
hereinafter.
D.
Description of the Parking Space.
(1)
Reserved parking spaces under this section shall be reviewed
biennially.
(2)
Only one reserved parking space per application.
(3)
The reserved parking space will be 22 feet in length.
(4)
The reserved parking space shall be located in a space determined
by Borough Council per review and recommendation of the Borough's
Codes/Zoning Officer, Police Department and Highway Department.
(5)
The reserved parking space shall not interfere with utilities,
driveways, crosswalks, intersections, other signage or similar concerns.
(6)
The reserved parking space will be marked consistent with 75
Pa.C.S.A. § 3354(d)(2), as amended, and in accordance with
Borough practice.
E.
Fees. The following fees are hereby established:[1]
(1)
Application Fee. A nonrefundable application fee is required
at the time of submission of the application, in an amount determined
by resolution of Borough Council.
(2)
Renewal Fee. A nonrefundable renewal fee is required at the
time of submission of the renewal application, in an amount determined
by resolution of Council.
(3)
Signage Fee. A nonrefundable fee is required in an amount determined
by resolution of Council. Said fee shall be used to offset the cost
of the erection by the Borough of the signs, posts and markings designating
a reserved handicapped parking space. Payment of this fee must be
made before the designated parking spot will be marked.

F.
Renewal Application Procedure. All recipients of an on-street reserved
handicapped parking space within the Borough of Mechanicsburg shall
submit a renewal application and pay all required fees to the Borough
no less than every two years following the original approval date.
All existing recipients of an on-street handicapped parking space
within the Borough of Mechanicsburg shall submit a biennial renewal
application as requested by the Borough per application approved by
resolution of Council.
G.
Revocation of Handicapped Parking Space. A reserved parking space
may be revoked, or not renewed, by the Borough under any of the following
conditions:
(1)
Expiration, revocation or termination of the handicapped or
disabled registration plate or placard by the Commonwealth of Pennsylvania.
(2)
Any change in circumstances of the applicant that would reasonably
indicate that the reserved handicapped parking is no longer needed.
(3)
Use of handicapped parking is used primarily for others who
live at the registered residence and not for the primary benefit of
the applicant.
(4)
Any misrepresentation or omission on the application.
(5)
The applicant no longer lives at the registered residence.
(6)
Death of the applicant.
(7)
The vehicle is no longer registered to the residence in the
application.
(8)
Failure to pay applicable costs and fees associated with the
application.
H.
Other Handicapped Parking. This section shall not limit the discretion
of Borough Council to establish handicapped parking areas at other
locations where Borough Council deems appropriate.

Bus stops are hereby established at the near side of each intersection
along the routes through the Borough traversed by public buses. It
shall be unlawful for any vehicle, other than a bus discharging, picking
up or awaiting passengers, to be parked in any such bus stop.

1.
The parking of boats, truck tractors, trailers, and trucks, except those not exceeding 3/4 ton capacity, shall be prohibited on all streets in the Borough of Mechanicsburg which are located in residential districts according to the zoning classifications and regulations set forth in Chapter 27, as amended.
2.
Provided, trucks, truck tractors and trailers shall be permitted
upon any street in said residential districts for the purpose of making
deliveries to or picking up goods, wares, merchandise or materials
from premises situated upon any such street or alley.

Traffic and/or parking shall be regulated, prohibited and/or
restricted upon the streets being cleaned or cleared of snow, provided
nevertheless, that "no parking" signs shall be erected or placed on
said streets at least four hours in advance of the street cleaning
or snow clearing operation.

The owner of any vehicle parked so as to violate any provision
of this Part 3 shall be given a traffic ticket or citation, assessing
fines for violation in the following amounts:
A.
Twenty-five dollars for blocking an intersection, a street, an alley;
parking in a prohibited zone adjacent to a fire hydrant; blocking
private or public driveways or accessways.
B.
Fifteen dollars for parking in a prohibited zone too close to an
intersection, parking on any sidewalk within the Borough or parking
in a prohibited zone designated by an erected sign or by painted lines
indicating a "no parking" zone.
C.
Fifteen dollars for parking in the wrong direction on any street;
overparking in a limited parking zone not metered.
D.
Fifteen dollars for parking of boats, truck tractors, trailers and
trucks on residential streets.
E.
Not less than $25 nor more than $50 for parking in a reserved parking
space for a handicapped person or severely disabled veteran.
F.
Fifteen dollars for parking in excess of the time limitation set
forth in § 15-307A.
G.
Not more than $15 for stopping, standing or parking on the roadway
in violation of § 15-304A.

Certain public streets in residential areas may be subject to
vehicle parking from nonresidential uses, therefore depriving the
residents whose properties abut said streets of on-street parking
spaces in which to park their vehicles. Those streets in residential
areas affected by parking from nonresidential uses may also be subjected
to high degree of vehicle traffic, illegal parking, maintenance problems,
litter, and loitering which negatively impacts public safety and welfare
within the residential area. The establishment of a resident permit
parking program for residential areas adversely affected by vehicle
parking from nonresidential uses may facilitate efficient movement
of traffic by providing a resident on-street parking preference during
certain hours of the day and days of the week.
A.
NONRESIDENTIAL
RESIDENT
RESIDENTIAL AREA
Definitions. The meaning of terms used in § 15-311 shall be as follows:
All uses of land except single-family residential as identified in the Low-Density Residential (R-L) and Medium-Density Residential (ROM) Zoning Districts within Chapter 27.
A person who owns or leases real property within a residential
area and who maintains a bona fide occupancy at said property, including
members of said person's family and other such persons who may
reside with the owner/lessee.
An area zoned for Low-Density Residential (R-L) and Medium-Density Residential (R-M) development in accordance with Chapter 27.
B.
In determining that a specific residential area is eligible for the
resident permit parking program, the following factors shall be taken
into consideration by the Borough Council:
(1)
The possibility of a reduction in total vehicle miles driven
in the Borough of Mechanicsburg.
(2)
The likelihood of alleviating traffic congestion, illegal parking,
maintenance problems, litter, loitering, and related safety and welfare
concerns.
(3)
The availability and proximity of public transportation to the
nonresidential uses that generate on-street parking within the residential
area.
(4)
The desire and need of residents of a residential area for the
resident permit parking program.
(5)
The availability of off-street parking to serve the needs of
the nonresidential uses generating on-street parking within a residential
area.
(7)
The ability of individuals going to or from nonresidential uses
to safely access vehicles, as pedestrians, parked in residential areas.
C.
The public streets in a residential area designated for the resident
permit parking are those deemed "impacted," and hence eligible for
the residential permit parking program, on the basis of the following
findings by the Borough Council:
(1)
During any period of a calendar week, between the hours of 7:00
a.m. and 11:00 a.m., the number of vehicles parked (or standing),
legally or illegally, on the public streets in a residential area
shall be equal to 40% or more of the legal, on-street parking capacity
of the area. For the purpose of this criterion, a legal parking space
shall be 22 linear feet.
(2)
During the same period as specified in Subsection C(1), above,
10% or more of the vehicles parking (or standing) on the streets in
the residential area are not registered in the name of a person residing
in the area. For the purpose of this criterion, the latest available
information from the Bureau of Motor Vehicles and Licensing of the
Pennsylvania Department of Transportation regarding registration of
motor vehicles shall be used.
(3)
The findings stated in Subsection C(1) and (2) above shall be
met on no less than one occasion per calendar week, for not less than
two successive weeks. Moreover, a reasonable expectation shall exist
that on-street parking in a residential area from nonresidential uses
will continue without the institution of the resident permit parking
program.
D.
The public streets in a residential area designated for the resident
permit parking may also be those deemed "potentially impacted," and
hence eligible for the residential permit parking program, on the
basis of the following findings by the Borough Council of the Borough
of Mechanicsburg:
(1)
Residential areas in which parking from nonresidential uses
may be reasonably expected to occur should the resident permit parking
program be instituted in an impacted area.
(2)
Residential areas in which parking from nonresidential uses
occurs due to the migration of vehicular parking upon institution
of the resident permit parking program in a neighboring residential
area.
(3)
In the determination of a "potentially impacted" area the findings
stated in Subsection C above, regarding "impacted" areas, are not
applicable.
E.
Application for a resident parking permit shall be made to the Police
Department by the person desiring the permit, who shall be only the
owner or the driver of a motor vehicle who resides on or immediately
adjacent to a street or other location designated for the resident
permit parking program. A separate application shall be required for
each motor vehicle. Each application shall contain the following information:
(1)
The name of the owner or the driver, as the case may be, of
the motor vehicle.
(2)
The address of the owner or driver, as the case may be.
(3)
The make, model and registration number of the motor vehicle,
and the driver number as taken from the applicant's current driver's
license. The applicant shall be required, at the time of making application,
to present his driver's license and the vehicle registration
card.
F.
Upon receipt of the application and verification that the information which indicates that the applicant is entitled to participate in the resident permit parking program, the Mechanicsburg Police Department shall issue a parking permit. Said permit shall be permanently valid, as long as the recipient remains a qualified applicant in possession of the motor vehicle referenced within said application. It shall be unlawful and a violation of this § 15-311 for any person to display other than the current and valid permit while standing or parking on a public street posted for resident permit parking at any time when permits are to be displayed.
G.
Temporary parking permits may be issued by the Mechanicsburg Police
Department, to bona fide visitors of residents located within an area
designated for the resident parking program. The Police Department
may also issue two temporary resident parking permits to the owner(s)
of each single-family dwelling unit located within an area designated
for the resident permit parking program.
H.
Motor vehicles possessing appropriate handicapped designation, as issued by the Department of Transportation, indicating the handicapped status of the owner of the vehicle shall be exempt from the provisions of this § 15-311.
I.
The following provisions govern the use of resident parking permits:
(1)
Notwithstanding any provision of this section to the contrary,
the holder of a resident parking permit shall be permitted to stand
or park a motor vehicle operated by him on public streets posted for
resident permit parking during those times when permit parking of
motor vehicles is permitted in that area. While a vehicle for which
a resident parking permit has been issued is so parked, the permit
shall be displayed so as to be clearly visible on the vehicle, as
directed by the Mechanicsburg Police Department. A resident parking
permit shall not guarantee or reserve to the holder a parking space
within a designated resident permit parking area.
(2)
A resident parking permit shall not authorize its holder to
stand or park a motor vehicle in any place where or at any time when
stopping, standing or parking of motor vehicles is prohibited or set
aside for other specified types of vehicles, nor shall the permit
exempt its holder from the observance of any traffic or parking regulation
other than resident permit parking restrictions.
(3)
No person other than the permit holder shall use a resident
parking permit or display it on a vehicle. Any such use or display
by a person other than the permit holder shall constitute a violation
of this section by the permit holder and by the person who so used
or displayed the parking permit.
(4)
It shall constitute a violation of this section for any person
to falsely represent himself as eligible for a resident parking permit
or to furnish false information on an application to the Mechanicsburg
Police Department in order to obtain a resident parking permit.
J.
The Mechanicsburg Police Department shall have the authority to revoke
a resident parking permit of any permit holder found to be in violation
of any provision of this section. Upon written notification to him
of the revocation, the permit holder shall surrender the parking permit
to the Police Department. Failure to do so, when requested, shall
constitute a violation of this section.
K.
The following streets are established as resident permit parking
areas and it shall be unlawful for any person not issued and possessing
a valid resident parking permit to park, or stand a motor vehicle,
or allow any motor vehicle to be parked, or standing, on the following
listed streets between 7:00 a.m. and 11:00 a.m. on weekdays (except
legal holidays) between August 20 and the following June 20.

Signs shall be erected along the streets in the residential
permit parking areas indicating the days and hours under which parking
shall be by permit only.
|
L.
Any person, firm, or corporation violating any provision of this
section dealing with the resident permit parking program shall pay
a fine as follows:
(1)
The sum of $25 if the same is paid within five days at the Mechanicsburg
Police Department during the hours hereinafter set forth, or upon
failure to pay the sum of $25 within the time above mentioned, then
upon summary conviction before a Magisterial District Judge, be sentenced
to pay a fine of $50 and the costs of prosecution.

(2)
Fines shall be payable at the Mechanicsburg Police Department
during the hours of normal business operation, as established and
so posted by the Mayor.
