A. 
The Town Board or the Town Chair of the Town of Pacific has the specific statutory authority, powers and duties pursuant to §§ 60.22 and 60.24, Wis. Stats., and has the specific statutory authority, powers and duties to establish the special offices and to retain or appoint members of these special offices; to compensate members of these special offices; to establish the powers and duties of these special offices; and to terminate those with special offices.
B. 
The Town Board of the Town of Pacific has, by adoption of this chapter, confirmed the specific statutory authority, powers and duties noted above in Ch. 60, Wis. Stats, and has established, pursuant to Ch. 60, Wis. Stats., the power to establish these special offices, the power to retain or appoint these special officers, the power to remove the members in these special offices, the power to establish the powers and duties of these special offices and the power to terminate these special offices. This chapter repeals and replaces any previously adopted Town ordinance as to those matters that are provided for in this chapter.
A. 
Assessor.
(1) 
Appointment. The position of Town Assessor is an appointed position, for a term to be set by the Town Board but not to exceed three years.
(2) 
Duties. The Town Assessor shall have such powers and perform such duties as prescribed by state law, by supervisory personnel of the Wisconsin Department of Revenue and by the Town Board. Among other responsibilities, the Assessor shall attend all meetings of the Board of Review.
B. 
Attorney.
(1) 
Appointment. The position of Town Attorney is an appointed position. The Town Attorney may be appointed by the Town Board and shall serve at the pleasure of the Board.
(2) 
Duties. The Town Attorney shall be duly admitted to practice law in Wisconsin and shall have the following duties:
(a) 
He/she shall conduct all of the law business in which the Town is interested.
(b) 
He/she shall, when requested by Town officers, give written legal opinions, which shall be filed with the Town.
(c) 
He/she shall draft ordinances, bonds and other instruments, as may be required by Town officers.
(d) 
He/she may appoint an assistant, who shall have power to perform his/her duties and for whose acts he/she shall be responsible to the Town. Such assistant shall receive no compensation from the Town, unless previously provided by ordinance.
(e) 
The Town Board may employ and compensate special counsel to assist in or take charge of any matter in which the Town is interested.
(f) 
The Town Attorney shall perform such other duties as provided by state law and as designated by the Town Board.
C. 
Building Inspector.
(1) 
Contract for services. The Board shall enter into a contract for the performance of the services of the Building Inspector. This position may be held by an individual or a firm, under terms set forth in a contract to be approved by the Town. At all times, the individual or firm serving in that position shall provide for a licensed and credentialed person(s) to perform those inspections and, in the event a backup inspector is needed to perform those services temporarily or under special circumstances, shall provide for a backup inspector, who is appropriately licensed and credentialed, which backup inspector shall be subject to prior Board approval. It shall also be the Town Building Inspector's responsibility to maintain Town records in his/her possession for the periods required by the Town, provide appropriate documentation to the Town for its records on matters coming before the Town for action, and promptly provide, without charge, any other documents to the Town, from the Town's records in the possession of the Town Building Inspector, that the Town may request.

(2) 
Powers and duties.
(a) 
The Building Inspector shall enforce all applicable building codes and all other ordinances, laws and orders of the Town and state which relate to building construction, alteration and repair.
(b) 
The Building Inspector, [Plumbing Inspector, Electrical Inspector and Heating, Ventilation and Air Conditioning (HVAC) Inspector] shall make all on-site inspections necessary for compliance and enforcement of the applicable building codes.
(c) 
The Building Inspectors shall have the power to order all work stopped on construction, alteration or repair of buildings in the Town when such work is being done in violation of any Town ordinance. Work shall not be resumed after the issuance of such an order, except on written permission of the Building Inspector.
(d) 
The Building Inspector shall issue or cause to be issued all proper permits for such work after payment of the fees required therefor. Inspectors shall process all applications, make all inspections, and have the authority to issue or cause to be issued a certificate of completion.
(e) 
The Building Inspector shall verify that proper permits have been issued relating to projects/operations over which he/she has oversight.
(f) 
The Building Inspector shall issue citations and issue complaints on behalf of the Town for violations of any Town ordinances in regard to which he/she oversees for the Town.
(3) 
Right of entry. Inspectors shall have the power to make or cause to be made an entry into any building or premises where the work of altering, repairing or constructing any building or structure is going on, including plumbing and electrical work.
D. 
Clerk.

(1) 
Appointment.
(a) 
Pursuant to §§ 60.10(1)(b)2m and 60.30(1e), Wis. Stats., the office of the Town Clerk shall be filled by appointment of a majority of the members-elect of the Town Board.
(b) 
The term of office for the appointed position shall be set by the Town Board but may not exceed three years per § 60.30(1e)(f). The Town Board may reappoint the Clerk for additional terms. However, removal by the Town Board during a given term of that office may only be for "cause" as defined under § 17.001 and required by § 60.30(1e)(f).
(c) 
This subsection is subject to the Town Board receiving authorization to change the position of the Town Clerk to an appointed position at a town meeting under § 60.10(1)(b)2m and § 60.30(1e)(e).[1] The question at the Town Meeting shall be:
"Shall the person holding the office of Town Clerk in the Town of Pacific be appointed by the Town Board?"

(d) 
The salary of the appointed Town Clerk shall be set by the Town Board and may not be reduced during the term of office.
(2) 
Duties. The Town Clerk shall have such powers and perform such duties as prescribed by state law and as directed by the Town Board.
(3) 
When effective. This subsection shall be in full force and effect only after its Town Board passage, notice after passage in accordance with Wis. Stat. § 60.80 and authorization of this change in the position of Town Clerk to an appointed position at a Town Meeting pursuant to §§ 60.10(1)(b)2m and 60.30(1e)(e) Wis. Stats.
E. 
Cemetery Sexton.
(1) 
Appointment. The Cemetery Sexton shall be appointed by the Town Chair, subject to confirmation by the Town Board for an indefinite term. The Cemetery Sexton may at any time be replaced, with or without cause. A Town Board member may serve as Cemetery Sexton, and if a Town Board member serves as Cemetery Sexton, that Town Board member shall be entitled to receive the compensation set for that position within the limits set by state law but shall be disqualified from voting on any matters pertaining to the cemetery or its operations.
(2) 
Duties.
(a) 
Handling cemetery operations and arranging for the proper maintenance of the grounds and grave sites for the Town Cemetery, including selling plots and drafting the cemetery and perpetual care deeds; identifying the location and boundaries of cemetery lots for burials and monument companies; maintaining records of sales, burials and veterans lots; coordinating funerals with funeral directors, monument companies, grave digger(s), and obtaining bronze veteran flag holder plaques from Veterans Service Officer for deceased veterans graves; being available weekends and holidays for funerals to assist with traffic control, lower cremation remains on lots, fill in grave sites by hand after the funeral and removing excess fill and collecting fees at the time of funerals; maintaining lawn mower, weed eater and other equipment, taking inventory on all equipment; overseeing assistant sexton, checking time card, and relaying maintenance issues that need attention.
(b) 
Present a monthly report to the Town Board covering matters relating to the cemetery.
(c) 
Each year prepare a proposed annual cemetery budget for consideration by the Town Board.
F. 
Constable.
(1) 
Appointment. The position of Town Constable is an appointed position. The Town Constable shall serve at the pleasure of the Board.
(2) 
Authority. The Town Constable shall have the statutory authority, powers and duties prescribed under § 60.22(4), Wis. Stats.; § 60.35, Wis. Stats.; § 60.351, Wis. Stats., and § 60.56, Wis. Stats. Without limiting these powers and duties, the Town Constable shall have the following responsibilities:
(a) 
The Town Constable shall cause to be enforced and prosecuted violations of Town ordinances of which he or she has knowledge or information and may issue citations and/or complaints for ordinance violations and accept stipulations, forfeitures and fines for those violations.
(b) 
The Town Constable shall act of behalf of the Town Board, as directed, to:

See that all orders of the Town Board and ordinances of the Town are obeyed;
[2] 
Obtain necessary assistance, if available, in case of an emergency, except as provided in Ch. 323, Wis. Stats., for emergency government.
(c) 
The Town Constable shall see that the necessary permits and licenses, issued by the proper authority of the state, county or Town, are in the possession of or properly displayed by any person engaged in an activity or business within the Town for which such permit or license is required and that the permit or license holders have complied with the terms of such permits or licenses.
(d) 
The Town Constable shall attend all sessions of the Columbia County Circuit Court when required by the performance of the duties of the office.
(e) 
The Town Constable shall attend regularly scheduled monthly Board meetings of the Town Board and shall report on all activities performed.
(f) 
The Town Constable, in the performance of his responsibilities, shall not carry a firearm.
(3) 
Nonexclusivity. Appointment of the Town Constable does not preclude the Town Board from adopting any other ordinance or providing for the enforcement of any other law or ordinance relating to the same matters.
G. 
Deputy Clerk.
(1) 
Appointment. The position of Deputy Clerk is an appointed position. The Deputy Clerk may be appointed by the Town Clerk, upon approval of the Town Board. The Deputy Clerk shall serve at the pleasure of the Town Clerk.
(2) 
Duties. The Deputy Clerk shall perform such duties as designated by the Town Clerk and, if designated by the Town Clerk, may perform the Town Clerk's duties during the absence, sickness or other disability of the Town Clerk.
H. 
Deputy Treasurer.
(1) 
Appointment. The position of Deputy Treasurer is an appointed position. The Deputy Treasurer may be appointed by the Town Clerk, upon approval of the Town Board. The Deputy Treasurer shall serve at the pleasure of the Town Treasurer.
(2) 
Duties. The Deputy Treasurer shall perform such duties as designated by the Town Treasurer and, in case of the absence, sickness or other disability of the Town Treasurer, shall perform the Town Treasurer's duties.
I. 
Engineer.

(1) 
Appointment. The position of Town Engineer is an appointed position. The Town Engineer shall be appointed by the Town Board and shall serve at the pleasure of the Board. When authorized by the Town Board, the Town Engineer shall provide engineering services to the Town and review engineering plans for the Town. The Town Engineer shall also verify that proper permits have been issued relating to projects/operations over which he/she has oversight. The Town Engineer shall also issue citations and complaints on behalf of the Town for violation of any Town Ordinances in regard to which he/she oversees for the Town. It shall also be the Town Engineer's responsibility to maintain Town records in his/her possession for the periods required by the Town, provide appropriate documentation to the Town for its records on matters coming before the Town for action, and promptly provide, without charge, any other documents to the Town, from the Town's records in the possession of the Town Engineer, that the Town may request.

J. 
Treasurer.
(1) 
Appointment. The office of Town Treasurer is an appointed position. The person appointed to that position shall serve for a term of up to three years and may be reappointed by the Town Board. The Town Treasurer may be dismissed by the Board at any time for cause. The Treasurer's salary shall be reviewed annually.

(2) 
Duties. The Town Treasurer shall have the specific statutory authority, power and duties of the Town Treasurer of the Town of Pacific, noted above in Ch. 60, Wis. Stats., and other statutory authority, powers and duties of the Town Treasurer to manage and direct certain affairs of the Town of Pacific. The Town Treasurer shall receive and take charge of all money belonging to the Town of Pacific, or that money which is required by law to be paid into the Town treasury of the Town of Pacific, and shall disburse the money pursuant to Wisconsin Statutes and other applicable Wisconsin law and the directions of the Town Board. The duties listed below are not intended to be all inclusive but instead are intended to delineate general areas of responsibility and expectations.
(a) 
Receive/deposit cash.
[1] 
Receipt for and take charge of all money belonging to the Town.
[2] 
Deposit as soon as practical funds of the Town in the name of the Town in such public depositories designated by the Town Board.
[3] 
Record numbered receipts in receipt journal.
[4] 
Total cash receipts monthly/income ledger.
[5] 
Monitor cash flow to ensure sufficient funds are available.
(b) 
Receive/process claims/process payroll.
[1] 
Disburse funds held by the Town in accordance with Wisconsin law and the directions of the Town Board.
[2] 
Record cash disbursements in cash book.
[3] 
Total case book monthly.
[4] 
Prepare accounts payable and receivable transactions for posting, verify account information, provide accounts payable list for Board approval, generate checks for bill payments and cosign checks and oversee billing of amounts owed to the Town and collection of those amounts.
[5] 
Prepare payroll reports, W-2s, unemployment and worker's compensation documents.
(c) 
Investment policies/bank reconciliation/financial reporting.
[1] 
Manage the investments of the Town funds and provide current status, activity and performance reports to the Board. Invest funds in accordance with Board policies and coordinate investments with Board designees.
[2] 
Prepare interim financial statements.
[3] 
Reconcile monthly bank statements.
[4] 
Monthly reconciliation of cash flow analysis.
[5] 
Monthly balance sheet for Board meetings.
[6] 
Monthly reconciliation of investment portfolio.
[7] 
Complete investment transactions as needed.
[8] 
Annual financial report for April Annual Meeting of Electors.
[9] 
State financial Form C due May 1.
[10] 
Any other reports required by law or requested by the Town Board.
[11] 
Present the account books and supporting documents that may, from time to time, be required by the Town Board.
(d) 
Collection of real estate taxes, personal property taxes and dog licenses.
[1] 
Perform all duties relating to taxation required under Wisconsin law and make timely partial apportionment of tax levies as provided by law.
[2] 
Collection of taxes by mail and in person, with one day near the end of December and one day near the end of January, at the Town Hall.
[3] 
Collect fees, maintain records and issue appropriate dog licenses.
[4] 
Complete information for Columbia County (Clerk) regarding dogs in the Town.
[5] 
Cooperate with the Columbia County Treasurer in tax paying and collecting procedures, tax reporting, January and February tax settlements, issuing lottery credit forms and change of address information.
[6] 
Collect mobile home park parking fees (fees in lieu of personal property taxes).
[7] 
Prepare spreadsheet in Excel with current mill rate and assessment.
(e) 
Meetings.
[1] 
Attend monthly Town Board meetings and any additional meetings as requested by the Town Board.
[2] 
Attend annual meeting of the electors.
[3] 
Attend budget workshops and hearings.
[4] 
Meet with the Board designees on Town investments, as needed.
(f) 
Miscellaneous.
[1] 
Maintain and organize the Town's financial records.
[2] 
Maintain and organize historical financial records of the Town of Pacific.
[3] 
Work with Board on annual budget preparations.
[4] 
Provide information and assistance to the public, when requested, and process special assessment requests.
[5] 
Attend continuing educational seminars.
[6] 
Comply with Ch. 19, Wis. Stats., concerning records of which the Treasurer is the custodian.
[7] 
As to any audit, work with auditors, generate reports and present all financial data as required for the audit.
[8] 
Perform such other tasks as may from time to time be assigned by the Town Board.
[9] 
Such other duties, beyond those noted above, shall be established by the Town Board.
K. 
Weed Commissioner.
(1) 
Appointment. The position of Weed Commissioner is an appointed position. The Town Chair of the Town of Pacific may, pursuant to § 66.0517, Wis. Stats., appoint on or before May 15 of each year, a Weed Commissioner or Weed Commissioners. The person(s) appointed will hold office for one year and until a successor has been qualified. If more than one person is appointed, the Town Chair of the Town of Pacific shall divide the Town of Pacific into districts, and each Weed Commissioner shall be assigned a district.
(2) 
Duties. A Weed Commissioner shall have such powers and perform such duties as prescribed by state law and as directed by the Town Board.
L. 
Facility Coordinator.

(1) 
Appointment. The position of Facility Coordinator is an appointed position. The Facility Coordinator may be appointed by the Town Board and shall serve at the pleasure of the Board.
(2) 
Duties.
(a) 
Coordinating with renters of the Town Hall.
(b) 
The opening of the Town Hall for events.
(c) 
Overseeing the event for the Town.
(d) 
Completing the checklist, noting cleanup that needs to be completed, and any damages from the event.
(e) 
Securing the Town Hall properly after the event.
(f) 
Promptly providing the completed checklist form to the Town Clerk for the Clerk's processing of the security deposit.
(g) 
Completing any other related responsibilities as shall be designated by the Town Board.
M. 
Assistant Facility Coordinator.

(1) 
Appointment. The position of the Assistant Facility Coordinator is an appointed position. The Assistant Facility Coordinator may be appointed by the Town Board and shall serve at the pleasure of the Board.
(2) 
Duties. The Assistant Facility Coordinator shall perform the services of the Facility Coordinator when the Facility Coordinator is unable or unavailable to provide those services, under the same terms that apply to the Facility Coordinator.
