There is hereby established a Joint City-County Airport Zoning Board to be known as the "Otero County-Alamogordo Airport Zoning Board," hereinafter called "Joint City-County Airport Zoning Board," pursuant to authority conferred by NMSA 1953, § 44-2-11, and NMSA 1953, §§ 14-40-14 through 14-40-24;[1] such Joint City-County Airport Zoning Board shall have the powers and exercise the duties set forth in NMSA 1953, §§ 14-40-14 through 14-40-24.

The Joint City-County Airport Zoning Board shall be composed of two members to be appointed by the Mayor and confirmed by the governing body of the City of Alamogordo; two members to be appointed by the Board of County Commissioners of Otero County, and one member to be appointed by a majority of the other members appointed as provided for herein. Said fifth member so appointed shall serve as Chairman of the Joint City-County Airport Zoning Board.
The members of the Joint City-County Airport Zoning Board shall be appointed to serve for a period of three years from the date of their respective appointments. Such initial appointments are to be made and confirmed within 30 days after the creation of the Joint City-County Airport Zoning Board; provided, however, that the failure of either political subdivision to appoint members to such Board shall not invalidate any action taken by the Board to implement and enforce the Municipal Airport Zoning Laws as provided in NMSA 1953, § 44-2-11, and such Airport Zoning Laws as are contained in NMSA 1953, §§ 14-40-14 through 14-40-24.[1]

The members of the Otero County-Alamogordo Airport Zoning Board shall be removable for cause by the appointing authority upon written charges and after a public hearing.
