There is hereby created an Otero County Planning Commission to be composed of seven members who shall be residents of Otero County.
A. 
The Board of County Commissioners shall appoint one member from each of the cities of Alamogordo, Tularosa and Cloudcroft. The remaining four seats shall be appointed from rural areas within the boundaries of Otero County.
B. 
The Board of County Commissioners shall make their appointment(s) within two regularly scheduled Commission meetings from any vacancy created within the Otero County Planning Commission, regular member seats, by either expiration of term or any other reason.
C. 
In addition to the seven regular voting members of the Otero County Planning Commission, administrative officials of the County and other appropriate agencies may be appointed as ex officio nonvoting members of the Planning Commission.
D. 
Once appointed, all members of the Otero County Planning Commission shall take the following oath of office administered by a person authorized to do so pursuant to the New Mexico Statutes:
I do solemnly swear or affirm that I (name) will uphold and abide by the Laws and Constitution of the United States of America, the State of New Mexico and the Ordinances of the County of Otero; and will faithfully and impartially discharge my duties as a member of the Otero County Planning Commission.
E. 
The written oath of office shall be filed with the Otero County Administration office and there kept for public inspection.
A. 
The term of each regular member of the Otero County Planning Commission shall be for two years.
B. 
The term of each ex officio member of the Otero County Planning Commission shall be two years from the date of appointment.
C. 
Those regular members of the Otero County Planning Commission who shall be first appointed shall have terms as follows: four members shall be appointed for a term expiring December 31, 1998, and three members shall be appointed for a term expiring December 31, 1999.
D. 
Thereafter, upon expiration of the term of any regular member, such vacancy shall be filled by the appointment as hereinabove provided of a member whose term shall be two years. In the event a vacancy occurs in the Otero County Planning Commission prior to the expiration of the term of that regular member, it shall be filled by appointment as hereinabove provided of a regular member whose term shall expire at the end of the original term in which said vacancy occurred.
E. 
If any vacancy shall occur by either expiration of term or any other reason of the seat of an ex officio member of the Otero County Planning Commission, reappointment or appointment of a new ex officio member by the Otero County Commission shall be discretionary. In the event a vacancy occurs in the Otero County Planning Commission prior to the expiration of the term of an ex officio member, it may be filled by appointment as hereinabove provided of an ex officio member whose term shall expire at the end of the original term in which said vacancy occurred.
A. 
The Otero County Planning Commission shall file an annual report with the Board of County Commissioners of its activities, meetings and progress. Such report shall be presented by the Planning Commission Chairman to the Board of County Commissioners at a time sufficiently before a regularly scheduled Commission meeting so that such report can be made part of the agenda for that Board of County Commissioners' meeting.
B. 
The Board of County Commissioners may remove any regular member of the Otero County Planning Commission at an appropriately called Board of County Commissioners' Meeting.

A. 
The Otero County Planning Commission shall have such authority as necessary and proper in reviewing subdivision applications and sustainable development test site applications to carry out and promote Otero County planning as set forth by the Board of County Commissioners. The Otero County Planning Commission shall recommend to the Board of County Commissioners programs and planning strategies with the general purpose of guiding and accomplishing a coordinated, adjusted and harmonious development of Otero County which will, in accordance with existing and future needs, best promote health, safety, welfare, order, convenience, prosperity, efficiency and economic development as those needs are determined by the Board of County Commissioners.
B. 
The Otero County Planning Commission shall have the authority to call before it any and all elected officials, department heads, officers and employees of Otero County, who shall, at the reasonable request of the Planning Commission, furnish such data, information and reports as the Otero County Planning Commission may reasonably request.
C. 
The Otero County Planning Commission shall have the power to recommend all subdivision applications and sustainable development test site applications for approval by the Board of County Commissioners. The Otero County Planning Commission shall have the authority to recommend denial of subdivision applications and sustainable development test site applications by the Board of County Commissioners. The Otero County Planning Commission shall have the authority to approve summary review subdivisions.
D. 
Appeals from the Otero County Planning Commission shall be determined through the Planning Commission’s rules and regulations as set forth below.
E. 
The Otero County Planning Commission shall have such other powers, authority and jurisdiction as may be from time to time delegated to said Planning Commission by resolution of the Board of County Commissioners.
A. 
The Otero County Planning Commission shall adopt rules and regulations for the conduct of its business, together with procedures for compliance with the rules and regulations.
B. 
The Otero County Planning Commission shall elect a Chairman, Secretary, and such other officers as they may deem necessary. The powers of such officers shall be established by the Otero County Planning Commission by resolution.
C. 
The Otero County Planning Commission shall meet at least once a month, but may meet more often if deemed necessary by its members. The Otero County Planning Commission shall establish a regular time of business. For the conduct of ordinary business, a quorum of the Otero County Planning Commission shall consist of a majority of the presently seated member. All meetings shall be scheduled pursuant to and shall comply with the New Mexico Open Meetings Act, NMSA 1978, § 10-15-1 et seq.
The Board of County Commissioners of Otero County, due to the heavy work load of the Otero County Planning Commission and the resignation of several members of the Planning Commission creating a severe burden on the remaining members of the Planning Commission which directly effects the health, safety and welfare of the citizens of Otero County, do hereby declare an emergency pursuant to NMSA 1978, § 4-37-7, and, accordingly, declare that this article shall take effect immediately.
