The Borough of Burnham hereby ratifies and confirms the prior establishment of a pension plan for its full-time, uniformed employees, including that plan and amendments thereto adopted pursuant to Ord. 1981-3, and an amendment thereto adopted by Ord. 1989-3, and hereby further amends said plan per the "Defined Benefit Pension Plan Joinder (Subject to Act 600) Joinder Agreement for the Borough of Burnham Police Pension Plan" dated November 18, 1991, attached hereto, incorporated herein by reference and marked "Exhibit A."[1]

The plan adopted, as amended, is the Pennsylvania State Association of Boroughs Master Plan and Trust in effect on the date of this Part, and as amended it may be amended from time to time in the future.

The President of Borough Council, or in his absence or disability, the Vice President of Borough Council, together with the Borough Secretary, or in her absence or disability, the Assistant Secretary, are hereby authorized and directed to execute the "Defined Benefit Pension Plan Joinder (Subject to Act 600) Joinder Agreement for the Borough of Burnham Police Pension Plan," dated November 18, 1991, a true copy of which is attached hereto as "Exhibit A"[1] and which is hereby adopted and noted hereinafter as the "Joinder Agreement," with the Trustee of the Pennsylvania Association of Boroughs Master Plan and Trust or their authorized representative. This "Joinder Agreement," as amended, shall supersede, replace and supplant any previously executed "Joinder Agreement" in relation hereto.

The Borough shall perform all of the duties and responsibilities assigned to it and may, at the discretion of Borough Council, exercise all powers vested in it by the said Police Pension Plan to the extent adopted and indicated in said "Joinder Agreement," attached hereto as "Exhibit A."[1]

The full-time uniformed employees (police) of the Borough shall have all the rights and all of the duties indicated by the "Joinder Agreement" and may exercise any options granted them by the terms of said Police Pension Plan to the extent adopted and indicated in said "Joinder Agreement."

The proper officers or agents of the Borough are authorized to do all things necessary and appropriate to implement and provide said Police Pension Plan to the included employees to the extent adopted and indicated in said "Joinder Agreement."
