For purposes of this article, the following term shall have
the meaning indicated:
A location within the City of Union City for which the proposed
use of a building or portion thereof is for any use other than solely
a residential use.
The owner of a commercial establishment within the City of Union
City which applies for a certificate of occupancy or a certificate
of continued occupancy on or after June 1, 2013, or otherwise opens
for business after June 1, 2013, shall install at least one security
camera on the outside of the facade of the commercial establishment
and at least one security camera on the interior of the commercial
establishment. The owner shall submit a sketch depicting the placement
of the security cameras to the City Construction Official at the time
an application is made for a certificate of occupancy or certificate
of continued occupancy. The sketch depicting the placement of the
security cameras shall be reviewed by the Union City Police Department
and Construction Official. No certificate of occupancy or certificate
of continued occupancy shall be issued without the placement of the
security cameras being approved by the Construction Official and the
Union City Police Department. The security camera on the facade of
the commercial establishment shall be installed so as to maintain
continuous surveillance of the entrance to the commercial establishment
and the area of public sidewalk directly adjacent to such establishment.
The security camera on the interior of the commercial establishment
shall be installed so as to maintain continuous surveillance of all
areas accessible to the public therein. In the event that one exterior
and one interior security camera is insufficient to maintain the continuous
surveillance required above, the owner of the commercial establishment
shall install as many security cameras as may be deemed necessary
by the Construction Official and the Union City Police Department
in order to achieve such continuous surveillance.
Recordings from the surveillance cameras required by this article
shall be maintained for at least 60 days and shall be made immediately
available to the Union City Police Department in the event the recordings
are deemed necessary for an investigation.
