Thirty days prior to public hearing on this article, as required by Section 9D(2) of the Retiree Health Care Act,[1] the Retiree Health Care Authority was notified by certified mail of the public hearing on this article.

Pursuant to Section 9D of Chapter 6, Laws of New Mexico, 1990,[1] the County of Otero determines to be excluded from coverage under the Retiree Health Care Act.

This article shall become fully effective and have the full force of law immediately upon its passage by the Board of County Commissioners of the County of Otero because the Board declares that an emergency situation exists affecting the health, safety, and/or welfare of the employees and citizens of Otero County, New Mexico.
