The Board of County Commissioners hereby repeals any and all ordinances which conflict with the purposes and intent of this chapter. This chapter shall become effective on the 15th day of April 1999.
A. 
The Board of County Commissioners hereby establishes a fee in the amount of $1 PTE to be paid by those commercial persons, entities or corporations for the use of the Otero County Tire Recycling Center.
B. 
"Use of the Otero County Tire Recycling Center," for the purposes of this chapter, shall be defined as dumping of waste tire or rubber products for recycling at the Otero County facility.
C. 
"Commercial use" shall be defined as the dumping of more than five tires in a one-month period.
The Board of County Commissioners hereby establishes the procedure for collection of fees by Otero County personnel which are paid by persons, entities or corporations for the use of the Otero County Tire Recycling Center. The procedure shall be as follows:
A. 
Otero County Convenience Station personnel shall be present at the gate to the facility and shall stop all vehicles before entering the facility.
B. 
Otero County Convenience Station personnel shall determine the number of tires to be dumped at the facility and shall present the fee amount to the person wishing to dump waste.
C. 
Otero County Convenience Station personnel shall receive payment in the form of cash, company check or personal check and shall return a written invoice reflecting the date, the number of tires dumped, the amount paid and the amount received.
D. 
A copy of the invoice shall be retained by County personnel.
E. 
All cash or checks shall be secured in a lock box which shall be balanced against the invoices daily.
F. 
The Otero County Convenience Station Manager shall make a written report to the Otero County Manager which reflects the daily balances by the close of business each Thursday.
G. 
The Otero County Convenience Station Manager shall be responsible for making deposits into the Otero County Treasurer (bank account) each day.
The Board of County Commissioners hereby authorizes the Otero County Convenience Station Manager to arrange for the sale of dumped tires and bundles to interested parties.
The Board of County Commissioners hereby establishes the procedure for the sale of dumped tires and bundles. The procedure shall be as follows:
A. 
The Otero County Convenience Station Manager shall receive all requests to purchase dumped tires or bundles.
B. 
The Otero County Convenience Station Manager shall set the price for the sale of dumped tires at $1 PTE and $35 per bundle.
C. 
The Otero County Convenience Station Manager shall invoice the purchaser and shall designate the number of tires to be purchased, the total amount due and the total amount received.
D. 
Otero County shall not advertise or solicit the sale of the tires or bundles.
