The Council of the Borough of Burnham, Mifflin County, Pennsylvania, hereby signifies its intention and desire to organize an Authority under the provisions of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," its amendments and supplements, for the purpose of exercising any and all powers conferred by said Act.

The Council, President of Council and the Secretary of the Borough hereby are authorized and directed to execute, on behalf of the Borough of Burnham, Mifflin County, Pennsylvania, Articles of Incorporation for said Authority, in substantially the following form:
Articles of Incorporation
TO THE SECRETARY OF THE COMMONWEALTH OF PENNSYLVANIA:
In compliance with the requirements of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," as amended and supplemented, and pursuant to an ordinance adopted by the municipal authorities of the Borough of Burnham, Mifflin County, Pennsylvania, expressing the intention and desire of the municipal authorities of said municipality to organize a municipal authority under said Act, the said municipality hereby does certify:
1.
The name of the Authority is "Burnham Borough Authority."
2.
The said Authority is formed under the provisions of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," as amended and supplemented.
3.
No other Authority has been organized under the said Municipality Authorities Act of 1945, as amended and supplemented, or under the Act of June 8, 1935, P.L. 463, as amended and is in existence in or for the incorporating municipality.
4.
The name of the incorporating municipality is Borough of Burnham, Mifflin County, Pennsylvania.
5.
The names and address of the municipal authorities of said incorporating municipality are: [Here followed the names and addresses of the municipal authorities of the Borough].
6.
The names and address and terms of office of the first members of the Board of the said Authority, each of whom is a resident and citizen of said incorporating municipality, are as follows: [Here followed the names and addresses and terms of office of the original members of the Board of the Authority].

The term of existence of the Burnham Borough Authority shall be for a period ending December 31, 2060.
In Witness Whereof the Borough of Burnham, Mifflin County, Pennsylvania, has cause these Articles of Incorporation to be executed by its Burgess and its President of Council, attested by its Secretary, and the seal of the Borough to be affixed, this 6th day of May, 1957.

The Burgess, President of Council and Secretary of the Borough further are directed to cause a notice of the substance of this Part, including the substance of the above Articles of Incorporation and of the proposed filing of the above Articles of Incorporation to be published once in a newspaper published and of general circulation in the County of Mifflin, Pennsylvania, as required by the said Municipality Authority Act of 1945, as amended and supplemented.

The Burgess, President of Council and Secretary of the Borough are further directed to cause said Articles of Incorporation, together with the necessary proofs of publication, to be filed with the Secretary of the Commonwealth of Pennsylvania, and to do all other acts and things necessary or appropriate to effect the incorporation of "Burnham Borough Authority," including the payment of any filing fees in connection therewith.

The following named persons be and they hereby are appointed as the first members of the Board of the Authority, for the following terms of office: [Here followed the names of the first members of the board and their terms of offices].

The adoption of this Part is deemed necessary for the benefit and preservation of the public health, peace, comfort and general welfare of, and will increase the prosperity of, the people of the Borough of Burnham, Mifflin County, Pennsylvania.

Pursuant to § 5610(d) [53 Pa.C.S.A. § 5610(d)] of the Municipality Authorities Act, as it may be amended and supplemented, the Borough Council of the Borough of Burnham hereby fixes the salary to be paid (from the funds of the Burnham Borough Authority) to a member of the Board of the Burnham Borough Authority at $600 per annum, payable quarterly, with the quarters being established as January through March, April through June, July through September and October through December of each year.

Nonetheless, in accordance with the provisions of § 5610(d) [53 Pa.C.S.A. § 5610(d)] of the Municipality Authorities Act, as it may be amended and supplemented, no salary of an Authority member shall be increased or diminished by the Borough of Burnham, as the governing body, during the term for which a Burnham Borough Authority member has been appointed.

Accordingly, the salary hereby fixed to be paid shall first be paid to the member of the Board of the Burnham Borough Authority who is appointed for the full five-year term commencing the first Monday in January 2012 (i.e., January 2, 2012) and thereafter, in successive sequence, to the member of the Board of the Burnham Borough Authority who is appointed for the full five-year term commencing on the first Monday in January 2013, and so on, until all five Board members shall receive such salary.
