In this article, the following terms shall have the meanings indicated:
OWNER
A. 
The registered owner of a motor vehicle or a lessee of a motor vehicle under a lease of six months or more.
B. 
"Owner" does not include:
(1) 
A motor vehicle rental or leasing company; or
(2) 
The holder of a special registration plate issued under Title 13, Subtitle 9, Part III of the Transportation Article of the Annotated Code of Maryland.
RECORDED IMAGE
An image recorded by a speed monitoring system:
A. 
On:
(1) 
A photograph;
(2) 
A micro photograph;
(3) 
An electronic image;
(4) 
Videotape; or
(5) 
Any other medium; and
B. 
Showing:
(1) 
The rear of a motor vehicle;
(2) 
At least two time-stamped images of the motor vehicle that include the same stationary object near the motor vehicle; and
(3) 
On at least one image or portion of tape, a clear and legible identification of the entire registration plate number of the motor vehicle.
SCHOOL ZONE
An area within a certain radius of any school that has been so designated by either:
A. 
The State Highway Administration; or
B. 
The County Commissioners of Charles County.
SPEED MONITORING SYSTEM
A device with one or more motor vehicle sensors producing recorded images of motor vehicles traveling at speeds at least 12 miles per hour (mph) above the posted speed limit.
A. 
The Office of the Sheriff is authorized to use speed monitoring systems for the purpose of determining the speed of a vehicle traveling within a designated school zone.
B. 
The Office of the Sheriff is authorized to issue citations to vehicle owners based upon the speed recorded by the "recorded image" of the speed monitoring system.
C. 
No citation may be issued for a period of at least 30 days after the first speed monitoring system is placed. A violation recorded by any speed monitoring system during this thirty-day period may be enforced by the issuance of a warning.
It is the intent of this article to implement and exercise the use of speed monitoring systems in school zones as authorized by the Annotated Code of Maryland, Transportation Article, § 21-809. Accordingly, the provisions of this article are additional to and not a substitution for any and all of the provisions of Subtitle 8 of Title 21 of the Transportation Article, which are hereby incorporated herein by reference. In the event any conflict between the provisions of this article and the incorporated provisions of Subtitle 8 of Title 21 of the Transportation Article, then the provisions of Subtitle 8 of Title 21 of the Transportation Article shall control.
