On and after the effective date of this chapter, no person, owner, operator, real estate agent, firm or corporation who shall own, occupy, and/or possess real property, shall move into the Borough, or from place to place within the Borough, or remove from the Borough of Charleroi, or cause his personal property to be, so moved or removed, from any house, dwelling, structure of any kind, appurtenance or vacant realty within the Borough of Charleroi, Washington County, Pennsylvania, to any site or location either inside or outside the Borough of Charleroi, without the legal and equitable owner of said property having first obtained a permit therefor from the Secretary of the Borough of Charleroi.
Every person, owner, operator or real estate agent of real property seeking a permit to allow any person, firm or corporation to occupy any premises owned by said property owner shall file an application with the Secretary of the Borough of Charleroi setting forth the occupant's or proposed occupant's name(s), telephone number(s), the location of the premises, the owner's name, address and telephone number, and a description of the nature of the proposed use of the house, dwelling, structure of any kind, building, appurtenance or vacant realty, and, if for any residence purposes, the names and ages of the occupants. Upon completion of the application, the Borough Code Enforcement Officer or Health Inspector is authorized and empowered to inspect said premises (subject to an inspection fee in an amount as set from time to time by resolution of the Borough Council), and should said premises and application comply with all ordinances of the Borough of Charleroi and all other laws, then, and in that event, the aforesaid Secretary shall forthwith issue a permit of occupancy upon payment of a permit fee in an amount as set from time to time by resolution of the Borough Council.

Every person, owner, operator or real estate agent of real property seeking a permit authorizing an occupant of the said premises to remove from or cause his personal property to be so moved or removed from any house, dwelling, structure of any kind, building, appurtenance or vacant realty within the Borough of Charleroi shall file an application with the secretary of the Borough of Charleroi at least five days prior to such expected time of departure. Should the occupant depart without prior notification to or the knowledge of the owner of said real property, the owner shall be required to file said application with the Secretary of the Borough within five days subsequent to the date of movement or departure of the occupant and in said application said owner shall set forth the information outlined above as well as the reason for not filing said application five days prior to the expected time of departure.
Upon receipt of such application, it shall be the duty of the Secretary of the Borough of Charleroi to issue the requested permit, if the indicated use does not violate any of the ordinances of the Borough of Charleroi, and if there are no outstanding obligations due the Borough of Charleroi.
It shall be unlawful for any person, owner, operator or real estate agent of real property within the Borough of Charleroi to transport or remove or allow to be transported or removed the personal property of any person moving into, or out of, or moving from place to place within the Borough, or being removed from a house, dwelling, structure of any kind, building, appurtenance or vacant realty owned by said property owner within the Borough of Charleroi unless such property owner shall have first obtained a permit as hereinbefore provided. It shall be the duty of such person, property owner, operator or real estate agent to secure the required permit prior to the moving or removal of any personal property of the property owner/operator or another from any house, dwelling, structure of any kind, building, appurtenance or vacant realty as hereinbefore required.
Penalties shall be as set forth in Chapter 1, Article II, Enforcement; General Penalty, of this Code.
