The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
GARAGE SALE
Means any sale entitled "garage sale," "basement sale," "yard sale," "estate sale," "moving sale," "porch sale," "attic sale," "rummage sale," "flea market sale" or any other similar type of casual sale of tangible property on the premises of a residence, which is advertised by any means whereby the public at large is or can be made aware of such sale.
GOODS
Means and includes any goods, wares, merchandise or other property not purchased for the purpose of resale.
TEMPORARY BUSINESS
Means every person engaged in the retail sale and delivery of goods, wares or merchandise, unless his goods, wares or merchandise shall have been assessed for taxation in the Village during the current year.

No person stall engage in the temporary business of selling goods, wares or merchandise at retail within the Village from any lot, premises, building, room or structure without first obtaining a license. No such license shall be granted except upon certification of the Chief of Police and Village treasurer. Proof of sufficient insurance and payment of a license fee as established from time to time by resolution of the Village council are required. Individuals conducting residential garage sales shall be exempt from such license fee requirement. Persons having regularly established places of business in the Village, who are not otherwise subject to this article, shall not become subject to this article because of making incidental sales or deliveries.

No license shall be granted to any person owning any personal property taxes or other indebtedness to the Village, or who contemplates using any personal property on which personal property taxes are owing in the operation of such business, and the treasurer shall certify to the applicant's qualifications with respect to such indebtedness.

Any person selling, or offering for sale, any goods, wares or merchandise on behalf, and solely for the benefit, of any recognized public, charitable or religious purpose shall, after meeting all other requirements, be granted a license without payment of the fee required by § 22-72, except a fee may be charged as determined by the Village council if persons use Village facilities and/or services.
(a) 
Purpose. It is the purpose of this section to protect the health, safety and general welfare of persons and property within the Village through the regulation and control of garage sales, and to minimize the disruption of neighborhood activities and the psychological ill effects of the presence of perpetual garage sales upon adjoining residences and property owners.
(b) 
Limitations. A garage sale shall be limited to three consecutive days in duration. No more than two such sales shall be held at any one residence per calendar year.
