A.
No person shall ride or drive any animal or any motor vehicle over
or across any sidewalk in the City, nor operate a bicycle, skateboard,
scooter, roller blades, or any self-propelled conveyance upon the
sidewalk of any district in the City zoned for commercial use.
B.
Nothing in this section shall prohibit the use of conveyances designed
and used by disabled persons, so long as the individuals using such
conveyances do not exceed the speed of the normal flow of pedestrians
using the sidewalks.
No person shall obstruct or interfere with the complete and
full use of any sidewalk for pedestrian travel. No person shall unnecessarily
and willfully obstruct or interfere with free ingress and/or egress
to any building or structure without first obtaining the consent of
the owner or lessee thereof.
A.
Without having first obtained a permit as provided for by the City
Code, no person shall:
(1)
Erect a stand, box or any other structure on the streets or sidewalks
to sell or offer for sale therefrom any goods, wares, merchandise
or produce;
(2)
Place any trucks, vehicles or any other thing whatsoever upon the
streets or sidewalks and sell therefrom or offer to sell any goods,
wares, merchandise and produce;
(3)
Place goods, wares, merchandises or produce on the streets or sidewalk
in connection with any commercial enterprise.
B.
Exceptions. Merchandise may be displayed on and sold from the sidewalk
on such days and between such hours as shall be designated by the
City Council or its authorized representative for the purpose of holding
of special sidewalk sales, and only such portion of the sidewalk as
shall be specified by City Council or its authorized representative
may be occupied by such merchandise and/or stands or tables.
C.
In any district in the City zoned for commercial use, the owner or
tenant may display an advertising sign upon the sidewalk which abuts
the property with which the advertising sign is associated. The sign
may be displayed only during the hours in which the business is open
and may not occupy more than 40% of the innermost portion of the width
of the sidewalk closest to the building and farthest from the curb,
so that the remaining 60% of the sidewalk closest to the curb shall
remain open and unobstructed. Such a sign may not exceed four feet
in height.
The placement of any type of coin-operated dispensing machines
other than newspaper dispensing machines upon any public sidewalk
or street within any district of the City zoned for commercial use
is prohibited.
In all areas of the City, it shall be the responsibility of
the owner and lessee, if any, of the abutting property to keep the
sidewalk, together with any portion of his/her property paved and
used as a sidewalk or public walk, immediately in front of his/her
property in good order and repair and, at all times, free and clear
of all obstructions to safe and convenient passage, except as otherwise
regulated by this article. This shall include keeping and maintaining
such sidewalks free and clear of all dirt, trash and similar debris,
and maintaining the sidewalk free of any merchandise, signs or unauthorized
structure or appurtenance.
Any person violating any of the provisions of this article shall,
upon conviction in a summary proceeding before any Magisterial District
Judge having jurisdiction of such offense, be sentenced to pay a fine
of not more than $1,000 for each day that the violation continues,
or to undergo imprisonment not exceeding 90 days, or both.
