Pursuant to and in accordance with the provisions of N.J.S.A.
52:27D-119 et seq., the whole of the State Uniform Construction Code
set forth in N.J.A.C. 5:23-1.1 et seq. is hereby adopted as the Construction
Code of the Borough of Morris Plains and is hereby incorporated herein
by reference as though it had been set forth at length herein. The
adoption of this code shall constitute adoption of any subsequent
revisions or amendments thereto.

(a)
Any person or corporation, including an officer, director or employee
of a corporation, who:
(1)
Violates any of the provisions of the construction code of the Borough
of Morris Plains;
(2)
Constructs a structure or building in violation of a condition of
a construction permit;
(3)
Fails to comply with any order issued by the Borough's enforcing
agency or any official authorized to issue such order in accordance
with this article; or
(4)
Makes a false or misleading written statement or omits any required
information or statement in any application or request for approval
to the Borough's enforcing agency or its officials authorized
under this article to receive such information shall be subject to
a penalty of not more than $500).
(b)
Anyone who knowingly refuses entry or access to the construction
official or any subcode official or any other person lawfully authorized
to inspect any premises, building or structure pursuant to the construction
code of the Borough of Morris Plains or who unreasonably interferes
with such inspection shall be subject to a fine of not more than $250.
(c)
With respect to Paragraph (a)(3) of this section, a person shall
be guilty of a separate offense for each day that he fails to comply
with a stop-construction order validly issued by the Borough's
enforcing agency or any official authorized to issue such order and
for each week that he fails to comply with any other order validly
issued by the Borough enforcing agency or such official. With respect
to Paragraph (a)(1) and (4) of this section, a person shall be guilty
of a separate offense for each violation of any provision of the Construction
Code of the Borough of Morris Plains and for each false or misleading
written statement or omission of required information or statement
made in any application or request for approval to the Borough's
enforcing agency or official authorized to receive such information.
With respect to Paragraph (a)(2) of this section, a person shall be
guilty of a separate offense for each violation of the conditions
of a construction permit.

As used in this article:
Refer to any dwelling house, store or other building.

The owner or occupant of each building which fronts on any of
the public streets or public places within the Borough shall, at his
own expense, cause the same to be properly numbered in accordance
with the directions and requirements of this article.

The numbers shall be in Arabic numerals or in script, not less
than four inches (102 mm) in height with a minimum stroke width of
1/2 inch (12.7 mm). The numbers shall contrast with their background
and be placed conspicuously on the front of each building or in front
of such building in such manner as to be easily discernible from the
street.

The respective number for each and every lot of the Borough
having buildings thereon shall be as is designated for the particular
street or streets as shown on the Tax Maps of the Borough of Morris
Plains.

Upon the laying out or opening hereafter of any new public street
or public place in the Borough, the Borough Engineer shall designate
the house numbers for the several lots on said public street or public
place, and the buildings on the lots fronting thereon shall be numbered
in accordance with the numbers so designated.

In cases where the property owner shall have failed to ascertain
and affix upon any building the number or numbers applicable to said
building as provided in this article, the enforcing authority shall
serve a notice upon the owner, by personal service or by registered
or certified mail addressed to his last known address, to affix the
required number within three days after receipt of said notice.

The provisions of Section 1-9 of these Revised Ordinances shall
be applicable to this article.

This article shall be enforced by the Borough Fire Prevention
Official, all police officers of the Borough, the Borough Engineer,
the Superintendent of the Department of Public Works, the Health Officer,
the Construction Official, all code enforcement officers, the Zoning
Officer and/or their duly authorized designees.
