The following are permitted uses in the R Residential District:
A. 
One- or two-family dwellings.
B. 
Church or similar places of worship, parish houses, convents.
C. 
Public parks and playgrounds, golf courses and similar recreational areas not operated for gain.
D. 
Public schools or nonprofit private schools accredited by the New York State Department of Education.
E. 
Public libraries.
F. 
Any land or building used by the Town of Collins or the County of Erie for administrative purposes, water supply, sewerage facilities, fire or police stations.
G. 
Growing of crops and agricultural products, but not including buildings for the housing of livestock and grazing.

H. 
Farm stands. "Farm stand" means permanent or nonpermanent structure that is owned and/or operated by a farmer which primarily sells agricultural products and related goods to the general public. Farm would consist of one or more parcels of owned or rented land, which parcels may be contiguous or noncontiguous to each other.

(1) 
The size of the retail portion of the farm stand must not exceed 600 square feet.
(2) 
At least 75% of the retail area must be utilized for the sale of agricultural, dairy or horticultural products. A minimum of 50% of the retail area utilized for agricultural products must be dedicated to products grown on lands owned or leased by the farmer.
(3) 
No more than 25% of the retail floor area can be utilized for the sale of complimentary goods.
(4) 
All agricultural, dairy or horticultural products to be sold must be produced in New York State.
(5) 
Farm stands can offer either harvested or customer-picked products.
(6) 
Minimum off-road parking requirements are one space for 100 square feet of retail floor space.
(7) 
Stand must be 40 feet from shoulder of road.
The following are permitted accessory structures and uses in the R Residential District:
A. 
Private garage or parking space, including the parking of not more than one commercial vehicle, provided the vehicle is used by the occupant of the premises, does not exceed 3/4 ton rated capacity and is stored within a completely enclosed building.
B. 
Office of a resident doctor, dentist, physiotherapist, chiropractor or similar professional occupation subject to the following conditions:
(1) 
Such office shall be located within the dwelling.
(2) 
Not more than one additional person shall be permitted to practice on said premises and then only in the capacity of an assistant to the professional occupant.
(3) 
A minimum of five off-street parking spaces shall be provided for patients or clients exclusive of driveway and private garage. (See § 305-44.)
C. 
Home occupations as defined in § 305-3 of this chapter.
D. 
The keeping of not more than three roomers, lodgers, or transient guests.
E. 
Quarters for servants employed upon the premises.
F. 
Building for private horticultural purposes.
G. 
Private family swimming pool, provided it is confined to the area in the rear of the front setback line.
H. 
Signs as follows:
(1) 
One unlighted sign, not exceeding 10 square feet in area, advertising the sale or rental of the property upon which such sign is located, provided that such sign shall be set back from the street line not less than 1/2 of the required front yard depth.
(2) 
One bulletin board, not exceeding 20 square feet in area, for public, charitable, and religious institutions.
(3) 
An unlighted identification sign, not exceeding two square feet in area, related to an accessory office or home occupation permitted on the premises. Such sign shall be attached to the principal building.
A. 
Lot area: 20,000 square feet.
B. 
Lot width at building lines: 100 feet.
C. 
Front yard depth: 40 feet.
D. 
Side yards: total 25% of the lot width; ten-foot minimum side yard.
E. 
Rear yard: 25% of the lot depth, but need not exceed 50 feet.
The maximum height of principal buildings shall be 2 1/2 stories, not to exceed 30 feet.
