The Business Administrator shall be the local Pension Certifying Official in the City of Paterson.
Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program ("DCRP") when the individuals are employed as bonafide legitimate employees and not employed pursuant to a professional services resolution:
A. 
Business Administrator.
B. 
Department heads, including Corporation Counsel.
C. 
Municipal Engineer.
D. 
Municipal Court Judge.
E. 
Appointed members of local authorities, boards and commissions requiring Municipal Council approval.
F. 
Gubernatorial appointees requiring Municipal Council approval who serve in the City government for a fixed term.
Exceptions from enrollment in the DCRP program shall be as provided in Chapter 92 of the Laws of 2007, N.J.S.A. 43:15C-1 et. seq. and shall include, but not be limited to, the following:
A. 
Any public employment, office or position if the base salary is less than $1,500 per year.
B. 
Persons otherwise eligible for membership in the Teacher's Pension and Annuity Fund or the Police and Fireman's Retirement System.
C. 
Individuals holding professional licenses or certificates to perform and serving in any of the following capacities, regardless of the position held:
(1) 
Certified Health Officer.
(2) 
Tax Collector.
(3) 
Chief Financial Officer.
(4) 
Construction Code Official.
(5) 
Qualified Purchasing Agent.
(6) 
Tax Assessor.
(7) 
Municipal Planner.
(8) 
Registered Municipal Clerk.
(9) 
Licensed Uniform Subcode Inspector.
(10) 
Certified/Principal Public Works Manager.
D. 
Other exceptions as provided by law.
This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007, N.J.S.A. 43:15C-1 et. seq., as amended from time to time, and any regulations or guidance documents from the Local Finance Board or the Division of Pensions and Benefits.
