As used in this article, the following terms shall have the meanings indicated:
FORM OF IDENTIFICATION
Any ID containing a picture, including a valid driver's license or military ID or, in lieu of a picture card, an unexpired credit card.
HOTEL
A building designed for occupancy as a temporary residence of individuals who are lodged with or without meals and in which no provision is made for cooking in individual rooms or suites.
MOTEL
Synonymous with motor courts and/or motor hotels and refers to a series of attached or semiattached dwelling structures. Each unit has convenient access to parking space for the use of the unit's occupants. The units, with the exception of the manager's office or caretaker's office, are designed to provide sleeping accommodations for automobile transients or overnight guests.
OWNER
The owner of any hotel or motel, including a partnership, individual and/or corporation or any other type of entity.
The owners and/or their employees or agents of any hotel or motel located within the Borough of Moosic are required to obtain from any guest or individuals staying at said facility said guest or person staying at that facility's name, home address and phone number.

The owners of any hotel or motel located within the Borough of Moosic will be required to physically obtain from any and all guests or individuals staying in their facility a form of identification.
All owners and/or their agents and/or employees of the hotel or motel located within the Borough of Moosic are hereby required to obtain a photocopy of the form of ID provided by the guest or any individuals staying at the hotel, and they are further required to maintain and keep said photocopy of the form of ID for a period not less than 90 days from the last day the guest or person staying there actually stayed at the hotel or motel.
Any person who violates or permits a violation of this article, upon being convicted before a District Justice, shall pay a fine not exceeding $600 and any costs incurred by the Borough of Moosic, and in default of payment of the fines and costs shall be subject to imprisonment in the Borough jail for a period not exceeding 30 days. Each day of the violation shall be considered separate violations and offenses.

The following words and phrases when used in this article shall have the meanings given to them in this section unless the context clearly indicates otherwise.
RESIDENTIAL OCCUPATIONS
Where the occupants are primarily transient in nature, including but not limited to, boardinghouses, hotels, and motels.
The Borough of Moosic, through its authorized designee, is authorized and directed to inspect, on an annual basis, all residential occupations to determine their compliance with the most current edition of the ICC International Property Maintenance Code and other building codes as adopted by the Borough of Moosic.
A. 
Any residential occupations subject to this article are required to obtain a yearly permit from the Borough of Moosic.
B. 
The issuance of the annual permit shall be followed by an annual inspection by the Borough of Moosic, to ensure the premises are free from any violations of any Borough building codes or other state and local laws, rules, and/or regulations concerning safety.
C. 
Any permits issued shall be posted on the premises and be available for inspection by the appropriate inspectors of the Borough.
D. 
The Borough Council shall adopt, by separate resolution, a fee schedule for the annual inspection and reinspections.
A. 
If the inspection discloses violations of the appropriate building codes the residential occupations shall have 30 days to correct said violations, provided that if said violations present a danger to person and/or property, the Borough may take condemnation action under the Borough building codes.
B. 
If the residential occupations require more than 30 days to correct the deficiencies, the Borough may grant a reasonable time as determined by the Borough engineer, provided that the residential occupations post a bond or letter of credit to insure the correction of the deficiencies.
C. 
Any deficiencies shall be reinspected by the appropriate Borough inspector to ensure correction of any deficiencies.
If any residential occupant violates any provision of this article, he shall, upon conviction thereof, be sentenced to pay a fine not to exceed $1,000 and costs, or in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day a violation of this article continues shall constitute a separate offense. The application of this penalty shall not be held to prevent the enforced removal of prohibited conditions.
The provisions of the article are severable, and if any section, subsection, sentence, clause, or part thereof shall be held or declared illegal, invalid or unconstitutional by any court of competent jurisdiction, the decision shall not affect or impair any of the remaining actions. It is declared to be the intent of the Borough of Moosic that this article would have been adopted if such illegal, invalid, or unconstitutional section, subsection, sentence clause, or part thereof had not been included.
