The New Jersey Uniform Fire Code, N.J.A.C. 5:70-1.1 et seq., shall be locally enforced within the Borough of Milford by adoption of this article, which Uniform Fire Code is hereby incorporated, in its entirety, by reference herein.
The local enforcing agency within the Borough of Milford shall be the Milford Borough Department of Fire Prevention, which is hereby created and established by this article.
The Department of Fire Prevention, the local enforcement agency, shall enforce the Uniform Fire Safety Act, N.J.S.A. 52:27D-192 et seq., and the Uniform Fire Code and regulations promulgated thereunder in all buildings, structures and premises within the established boundaries of the Borough of Milford, except owner-occupied one- and two-family dwellings and buildings owned or operated by the federal and state governments and interstate agencies, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.[1]

The Department of Fire Prevention established by § 14-2 of this article shall be under the direct supervision and control of a Fire Official who shall report to a Milford Borough Council member who shall be designated by the Mayor to serve as the Fire Liaison and/or Fire Chair. The Fire Official shall coordinate all daily activities and workload with the New Jersey State Code Enforcement Office.

A. 
Term of office. The Fire Official shall serve for a term of one year. Any vacancies shall be filled for the unexpired term. Inspectors and other employees as may be necessary for the Department of Fire Prevention shall be appointed by the governing body of the Borough of Milford upon the recommendation of the Fire Official.[1]

B. 
Removal from office. Inspectors and other employees of the Bureau of Fire Prevention shall be subject to removal by the Borough Council for misfeasance, misconduct and nonfeasance. The Fire Official shall also be subject to removal by the Borough Council for gross negligence, misfeasance, misconduct or malfeasance. Each inspector, employee or Fire Official to be so removed shall be afforded notice and opportunity to be heard by the appointing authority or designated hearing officer.
Pursuant to Sections 15 and 16 of the Uniform Fire Safety Act (see N.J.S.A. 52:27D-206 and 52:27D-207), any person aggrieved by an order of the Department of Fire Prevention shall have the right to appeal pursuant to applicable law.
The Department of Fire Prevention established by § 14-2 of this article shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs. The permit fees, annual registration fees for life-hazard uses and application fees shall be as set forth in N.J.A.C. 5:70-2.9, as amended, from time to time to be established by the State Uniform Fire Code, which shall be incorporated by reference herein.

The inspection schedule for non-life-hazard uses shall be on an annual basis.
B. 
In addition to the registrations required by the Uniform Fire Code, the following non-life-hazard uses shall register with the Department of Fire Prevention. These uses shall be inspected once per year and pay an annual fee. The fee schedule shall be as prescribed in Chapter 10, Fees, of this Code.[1]

C. 
Uses requiring registration with the State of New Jersey as life-hazard uses shall not be required to register under this section.
D. 
In the discretion of the Fire Official, vacant buildings will be charged and inspected according to the previous use of the building.
E. 
Nonprofit organizations shall be exempt from any fees but shall remain subject to Uniform Fire Code inspections and/or fines for noncompliance.
A. 
The application fees for the permits listed in N.J.A.C. 5:70-2.7(a) shall be provided by state regulation and shall be in the amount as set forth pursuant to N.J.A.C. 5:70-2.9(c).
B. 
Smoke detector and carbon monoxide alarm compliance inspection fees shall be in accordance with N.J.A.C. 5:70-2.9(d).
C. 
The cost for the issuance of a certificate of fire code status shall be as prescribed in Chapter 10, Fees, of this Code.[1]
