The right-of-way and roadway ditch adjacent to all occupied residential, commercial and industrial properties shall be maintained by the property owner. Maintenance shall include mowing, brush removal, removal of litter and debris, and cleaning, maintenance and replacement of driveway culverts with no changes to existing grades. No vegetation shall be allowed to exceed a height of three feet. Maintenance exemptions may be granted by the Village in the following situations:
A. 
The depth or slope of the roadway ditch makes maintenance hazardous.
B. 
The bottom of the ditch is consistently saturated or filled with water (maintenance is required up to the zone of saturation).
The right-of-way and roadway ditches adjacent to unoccupied residential, commercial and industrial property, and all agricultural property shall be maintained by the Village. The right-of-way may be left in a natural state or mowed by the Village in the Village's sole discretion. The Village shall be solely responsible for cleaning, maintaining and replacing culverts under Village roads.
