This Greenville Sanitary District Water Conservation chapters
prescribes that no person, firm, partnership, corporation, limited
liability company, limited liability partnership, or other entity
shall water or sprinkle or allow the same on a lawn or yard by means
of irrigation systems or sprinkling devices connected to a garden
hose with water from the Greenville Water Utility between the dates
of June 15 to September 1, except as provided herein.
This chapter and the provisions herein shall apply to all real
property, whether residential, commercial, industrial, agricultural,
or institutional, located within the boundaries of the Greenville
Sanitary District.
A.
Real property assigned even-numbered mailing addresses shall be permitted
to make such use of water on even-numbered calendar days starting
after 4:00 p.m. until 8:00 a.m. the next day/Central Daylight Time.
There shall be absolutely NO such use of water between 8:00 a.m. and
4:00 p.m.
B.
Real property assigned odd-numbered mailing addresses shall be permitted
to make such use of water on odd-numbered calendar days starting 4:00
p.m. until 8:00 a.m. the next day/Central daylight time. There shall
be absolutely no such use of water between 8:00 a.m. and 4:00 p.m.
The following exceptions shall apply:
A.
Newly seeded and newly sod lawns (installed between June 15 and September
1). Newly seeded and newly sod lawns may be watered every day for
not more than 40 days but only before 8:00 a.m. and after 4:00 p.m./Central
daylight time, upon the issuance of a permit issued by the Sanitary
District. Permits may be obtained at the Town Hall office, W6860 Parkview
Drive, Greenville, Wisconsin, during normal business hours. Permits
shall be displayed in plain view in the front window or if issued
for real property without a building, at such other location so as
to be in plain view. There shall be absolutely no such use of water
between 8:00 a.m. and 4:00 p.m.
B.
Handheld devices and children's water toys. Lawns, trees, shrubs,
gardens, and other outside plants may be watered by handheld devices,
such as sprinkling cans or handheld hoses, on any day at any time.
Children's water toys may be used at any time.
C.
Special cases. The Sanitary District may grant permits for water
usage outside the restrictions imposed herein in unique circumstances,
such as emergency conditions affecting health, fire protection, or
depriving a user of his or her financial livelihood.
D.
Emergency. Notwithstanding any other provisions herein, whenever,
in the opinion of the Sanitary District, a necessity to limit water
exists due to weather conditions, water usage, electrical power outages,
or other causes, the Sanitary District may for such time as the necessity
for water use limitation exists, issue orders and regulations, suspend
permits, alter days and hours, impose additional terms and conditions,
and prevent usage of water.
A.
First offense. Any person who shall violate any of the provisions
of this chapter shall, upon conviction thereof, be given a written
notice of the violation.
B.
Second and subsequent offense. Any person, firm, or corporation found
guilty of violating any provision of this chapter who had previously
been convicted and thus notified of a violation of the same chapter
within one calendar year shall, upon second conviction thereof, be
subject to a water shut off until the property owner signs a statement
pledging not to violate again. Upon a third violation of the chapter,
the property owner will receive a citation and will forfeit an amount
set from time to time by ordinance in the Fine and Forfeiture Schedule
of the Town of Greenville.[1]
C.
Continued violation. Each violation and each day a violation continues
or occurs shall constitute a separate offense. Nothing in this chapter
shall preclude the Sanitary District from maintaining any appropriate
action to prevent or remove a violation of any provision of this chapter.
The Sanitary District shall have any and all other remedies
afforded by the Wisconsin Statutes in addition to the forfeiture and
costs of prosecution above.
