[HISTORY: Adopted by the Borough Council of the Borough of Wilmerding 4-2-1985 by Ord. No. 845 (Ch. 1, Part 7, of the 1989 Code). Amendments noted where applicable.]
A. 
Accountants for the Borough of Wilmerding shall not sell real estate owned by the Borough for consideration in excess of $500 except to the highest bidder at a public auction after due notice by advertisement for bids in one newspaper of general circulation in the Borough. Such advertisements shall be published once, not less than 10 days prior to the date of the public auction. Said date shall be announced in said advertisement. The acceptance of the highest bidder shall only be by public announcement at a regular or special meeting of Council. All bids shall be accepted on the condition that payment of the purchase price in full shall be made within 60 days of the acceptance of said bids.
B. 
As further condition of the sale, the successful bidder shall, upon receiving notice of the acceptance of the successful bid, be required to remit payment to the Borough directly for all reasonable attorney's fees and engineering fees occasioned by the sale as well as the cost of advertising the property for sale. Said buyer shall take possession subject to any and all taxes, liens and other encumbrances on the property at the time of sale.

A. 
Any person interested in purchasing property shall make a specific request in writing to the Borough Council.
B. 
The request shall contain the mailing address as well as the following information:
(1) 
Metes and bounds description of the property;
(2) 
A Deed Book volume and page number reference;
(3) 
A survey or plot plan with the metes and bounds description contained thereon; and
(4) 
Any reference to public roadways or access to requested sale property.
C. 
A statement of intention to develop and/or maintain the property within one year from the date of the sale consistent with the existing Zoning Ordinance, Chapter 300, Zoning, of the Code.
D. 
An acknowledgment and agreement that all attorneys' fees incurred by the Borough through its Solicitor and all engineering fees incurred by the Borough through its Engineer to bring about the sale of said property shall be paid within 60 days of the awarding of the sale property to the highest bidder agreeing to pay the costs of advertising for the sale pursuant to law.
E. 
Any bidder who shall enter into a bid on property owned by the Borough of Wilmerding under the terms and conditions of an ordinance passed simultaneously with this policy procedure shall likewise be obliged to comply with the policy set forth herein above.
