Wilmerding Borough does hereby elect to adopt, administer and
enforce the provisions of the Pennsylvania Construction Code Act,
Act 45 of 1999, 35 P.S. § 7210.101 et seq., as amended from
time to time, and the regulations promulgated thereunder by the Pennsylvania
Department of Labor and Industry.
The Uniform Construction Code published in 34 Pa. Code Chapters
401 to 405, as amended from time to time, is hereby adopted and incorporated
herein by reference as the Wilmerding Building Code.
Wilmerding Borough shall enforce the Uniform Construction Code
through a duly appointed official, to be known as the "code enforcement
officer," by resolution, and/or by retention of code officials and/or
by third party agencies to act on behalf of the Borough and/or by
intermunicipal agreements with local governments or with the Pennsylvania
Department of Labor and Industry, as Council sees fit from time to
time.
A.
In lieu of the International Plumbing Code, Wilmerding Borough adopts
the Allegheny County Health Department Plumbing Code as its standard
plumbing code, as permitted by 35 P.S. § 7210.503(a).
B.
Enforcement. Wilmerding Borough does hereby designate the Allegheny
County Health Department, Plumbing Section, through its contractual
relationship with the Borough to be the duly certified and authorized
plumbing inspection third-party agency, meeting all of the statutory
requirements set forth in the Uniform Construction Code Act, 35 P.S.
§ 7210.701 et seq., as amended.
Appeals from a decision of the code enforcement officer shall
be made to a board of appeals which shall be established by simple
resolution in conformity with the requirements of the applicable provisions
of the code, as amended from time to time, and for the purposes set
forth therein. If enforcement and administration is undertaken jointly
with one or more other local governments, said board of appeals shall
be established by joint action of the participating local governments.[1]

Editor's Note: By adoption of Ord. No. 1016 on 4-3-2012, the
Borough of Wilmerding declared its intent to dissolve the Wilmerding
Borough Uniform Construction Code Appeals Board upon formation of
the joint Turtle Creek Valley Council of Governments Uniform Construction
Code Appeals Board.
A.
All building code ordinances or portions of ordinances which were
heretofore adopted on or before July 1, 1999, and which equal or exceed
the requirements of the code, shall continue in full force and effect
until such time as such provisions fail to equal or exceed the minimum
requirements of the code, as amended from time to time.
B.
All building code ordinances or portions of ordinances which are
in effect on the effective date of this article, the requirements
of which are less than the minimum requirements of the code, are hereby
amended to conform with the comparable provisions of the code.
C.
All relevant ordinances, regulations and policies of Wilmerding Borough
not governed by the code shall remain in full force and effect.
Fees and charges assessable for the administration and enforcement
of this article and the code shall be established by resolution from
time to time.
This article shall take effect on July 1, 2004.

As of the effective date of this article, the following enumerated
standard codes, except as noted below, are adopted to be in full force
and effect in the Borough of Wilmerding:

International Residential Code for One-Family and Two-Family Dwellings,
2006.
C.
International Mechanical Code, 2006.
D.
International Fire Code, 2006.
E.
International Fuel Gas Code, 2006.
F.
International Energy Conservation Code, 2006.
G.
International Existing Building Code, 2006.
H.
International Property Maintenance Code, 2006.
I.
International Code Council Electrical Code Administrative Provisions.
J.
ICC Performance Code for Buildings and Facilities, 2006.
For each code enumerated above, the appeals procedure shall
be to the Wilmerding Borough Zoning Hearing Board, and the appeals
provision of each code is deleted and not hereby adopted. Ordinance
No. 960 is hereby amended.[1]

Hereinafter, when any of the standardized codes enumerated above
are amended or revised, such amendment shall become the law of Wilmerding
Borough without further action by Borough Council.
