A certain document, a copy of which is on file in the office of the Secretary of the Township of Penn, being marked and designated as the "BOCA National Building Code, Thirteenth Edition, 1996," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Building Code of the Township of Penn, York County, Pennsylvania, for the control of buildings and structures as herein provided; and each and all of these regulations, provisions, penalties, conditions and terms of said BOCA National Building Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 100-3 of this chapter.
Ordinance No. 455[1] and all other ordinances or parts of ordinances in conflict
herewith are hereby repealed.

The following sections are hereby revised as follows:
A.Â
Section 100.1, Title, shall be amended to read as follows:
101.1 Title: These regulations shall be known as
the "Building Code of Penn Township," hereinafter referred to as "this
code."

B.Â
Section 112.3.1, Fee schedule, shall be amended to read as follows:
112.3.1 Fee schedule: Fee for plan examination,
building permits and inspections shall be set, from time to time,
by resolution of the Penn Township Board of Commissioners.

C.Â
In Section 113.2, Required inspections, the following shall be added
to the section: "Additional or follow-up inspections required through
no fault of the Township shall constitute an additional inspection
fee."
D.Â
Section 116.2, Notice of violation, shall be amended to read as follows:
116.2 Notice of violation: The Code of Penn Township
stipulates that no notice shall be required prior to the prosecution
of any violation under any Township ordinance. As a courtesy, the
Code Official may serve a notice of violation or order on the person
responsible for the erection, construction, alteration, extension,
repair, removal, demolition, use of occupancy of a building or structure
in violation of the provisions of this code, or in violation of a
detail statement or a plan approved thereunder, or in violation of
a permit or certificate issued under the provisions of this code.
Such order shall direct the discontinuance of the illegal action or
condition and the abatement of the violation.

The notice may be in one or more of the following forms:

Notification in person by the Code Official;

Notification by telephone;

3.

Written notification delivered by the Code Official or sent
through the mail system;

4.

Posting of the notice on the affected property.

Section 116.4, Violation penalties, shall be amended to read as follows:
116.4 Violation penalties: Any person who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan or directive of the Code Official, or of a permit or certificate issued under the provisions of this code, shall be subject to the fines and penalties as set forth in Chapter 1, Article II, General Penalty, of the Penn Township Code. Each day that a violation continues shall be deemed as a separate offense.

Section 117.2, Unlawful continuance, shall be amended to read as
follows:
117.2 Unlawful continuance: Any person who shall continue any work in or about the structure after having been notified or served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be subject to the fines and penalties as set forth in Chapter 1, Article II, General Penalty, of the Penn Township Code.

G.Â
Section 121.0, Means of Appeal, shall be deleted in its entirety.
H.Â
The following new section shall be added:
1005.5.2 Exterior openings above grade: All exterior
openings above grade which are intended to be used as a means of egress
(e.g., sliding doors) shall exit onto a minimum platform of three
feet by three feet. Reference CABO Section R-212.

Section 3408.2, Applicability, shall be amended to read as follows:
3408.2 Applicability: Buildings existing prior
to June 15, 1998, in which there is work involving alterations, additions
or changes of occupancy, shall be made to conform to the requirements
of this section or the provisions of Sections 3403.0 through 3407.0.

Nothing in this chapter or in the Building Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired or liability incurred, or any causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 100-2; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.

marked and designated as the "CABO One and Two Family Dwelling Code,
1992 Edition," published by the Council of American Building Officials,
be and is adopted as the One-and Two- Family Dwelling Code of Penn
Township, York County, Pennsylvania, whose purpose is to standardize
requirements by using a compilation of data from various national
model codes utilized by the Township of Penn.
