No person shall engage in the business of plumbing in Penn Township unless licensed as master plumber under the provisions of Code.
No person other than a master plumber licensed by the Township of Penn, or a journeymen plumber, employed by a master plumber and licensed by Penn Township, shall make or cause to be made connections to any plumbing fixtures, drain, waste, soil or vent pipe, or water supply system: provided, that nothing in this article shall be construed to prohibit the employment or working of apprentices under the direction of a licensed master plumber and in the immediate company of a licensed master or licensed journeyman plumber.
The fee for a master plumber's license and journeyman plumber's license shall be set by resolution by the Penn Township Board of Commissioners. All licenses issued by Penn Township shall expire on December 31 of the year for which they were issued. The period for issuing a license shall begin December 22 prior to the year for which the license is issued.
Any person applying for a license must show proof of passing the master plumbing test or has obtained a masters plumber's license in a municipality with equal plumber's licensing regulations or in the case of a journeyman plumber's license, they must show proof of passing the journeymen test or having obtained a journeyman plumber's license in a municipality with equal plumbing license regulations and provided further, that in all cases the applicant shall pay the respective fee as provided in § 218-3 of this article.
All licenses specified by this article shall be issued by the Township of Penn' s Secretary or Clerk.
No person holding either a master or journeyman plumber's license shall allow his name or license to be used by another either for the purpose of obtaining permits, or for doing plumbing work under said license. The Penn Township Secretary or Clerk shall keep a record of the business name and place of business licensees, and it shall be the duty of licenses to inform the Township Secretary or Clerk of any changes in either.
The Township of Penn may revoke any license issued under this article if said license was obtained through nondisclosure, misstatement, or misrepresentation of any material fact.
Any person who shall violate any provision of this article, upon conviction thereof, shall be sentenced to pay a fine of not more than $1,000, costs of prosecution, including attorney's fees, and restitution for any damage sustained by the Penn Township Sewer System as a result of the violation. In the event of default in the payment of fines, fees, costs or restitution, the person shall be sentenced to York County Prison for not more than 30 days. Every day that a violation of this article continues shall constitute a separate offense. In addition, said fines and penalties may be collected by suit brought in the name of the Township before any Magisterial District Judge or the Court of Common Pleas.
