Uniform construction codes — See Ch. 127.
As used in the chapter, the following terms shall have the meaning indicated:
SWIMMING POOL
Any structure intended for swimming, recreational bathing or wading that contains water over 24 inches deep. This includes in-ground, aboveground and on-ground pools, hot tubs, spas and fixed-in-place wading pools.[1]

No person shall construct, establish or create a swimming pool without having first registered same and obtained a permit therefor.
Any swimming pool having more than 24 inches of water will require a minimum barrier with a height of 48 inches to be installed as per the International Building Code.

Application for a permit for a swimming pool shall be made in writing to the Construction Official and the application shall show the complete design and plan, the location of the same, the size and the cost. The applicant shall pay a fee in accordance with the fee schedule set forth in § 127-4 of the Code. The Construction Official shall issue a permit if he/she finds the application to be in accordance with the State Uniform Construction Code, zoning ordinance and all health ordinances, codes, rules and regulations.
