As used in this article, the following terms shall have the meanings indicated:
AGENT FOR OWNER
Any person who can show written proof that he has authority to act for the property owner.
DORMITORIES TO INCLUDE FRATERNITY AND SORORITY HOUSES
A building designed for or used solely or primarily to provide housing for college or university students. The building may be publicly or privately owned, leased, operated, managed or otherwise controlled. Staff or monitors may also reside therein. The term "primarily" shall be construed to mean over 75% of the total design capacity of the building as permitted by local or state regulations, whichever is the more stringent.
DWELLING, MULTIPLE-FAMILY, TO INCLUDE GARDEN APARTMENTS
A building or portion thereof containing or designed to contain three or more separate dwelling units with or without common access facilities.
DWELLING UNIT
One or more rooms designed for or occupied by one family for living purposes and containing cooking, living, sanitary and sleeping facilities for use solely by one family. All rooms comprising a dwelling unit shall have access through an interior door to other parts of the dwelling unit.
MOBILE HOME PARK
A tract of land in single ownership upon which are placed two or more mobile homes, which has been developed with all necessary facilities and services in accordance with a site development plan meeting all the requirements of this article, and which is intended for the express purpose of providing a satisfactory living environment for mobile home residents on a long-term occupancy basis.
PLANNED RESIDENTIAL DEVELOPMENT
An area of land, controlled by a landowner, to be developed as a single entity for a number of dwelling units, the development plan for which does not correspond in lot size, bulk or type of dwelling, density, lot coverage and required open space to the regulations established in the district where planned residential development is permitted.
ROOMING HOUSE, TO INCLUDE A BOARDING, LODGING OR TOURIST HOME
A building other than a dormitory, hotel, fraternity or sorority house containing not more than one dwelling unit occupied by a family and providing, for compensation, rooming units for the lodging of not more than 10 individuals in addition to the family.
ROOMING UNIT
A room or rooms constituting a separate, independent housekeeping unit that is physically separated from any other rooms, dwelling units, or rooming units in the same structure. The rooming unit shall contain living and sleeping facilities but not cooking or eating facilities and shall be occupied by no more than one family.
TOWNHOUSE or ROW HOUSE
Three to eight separate dwelling units attached to each other by party or common walls, with each unit having individual access and rear common or private garden orientation.
A. 
Whoever, as owner, landlord, manager, or agent for owner, rents any dwelling unit or room or rooms for a period in excess of 30 days shall supply the Borough Administrator/Secretary with the following information:
(1) 
The dwelling unit number or street address.
(2) 
The name or names of all persons to occupy such dwelling unit.
(3) 
The mailing address of the room or dwelling unit.
(4) 
The period of time for which the rental is made.
B. 
Such information shall be supplied to the Borough Administrator/Secretary within 10 days of the renting, leasing or subleasing of any dwelling unit or rooms.
The officers of any fraternities or sororities, the owner of any rooming house or private home in which rooms are rented shall maintain within said home at all times a registry containing the names, local mailing address and home mailing address of all tenants or occupants. Such registry shall be kept current at all times and shall be available for inspection by the Borough Code Enforcement Officer at any time during normal business hours. In addition to such registry, the officers of a fraternity or sorority, rooming house, owner or agent for owner shall comply with the provisions of § 221-2 hereof.
Any owner, operator, manager or agent for owner of a mobile or manufactured home park established in accordance with Chapter 350, Subdivision and Land Development, and Chapter 375, Zoning, shall, in addition to complying with § 221-2 hereof, also maintain a registry in accordance with § 221-3 hereof and, in addition, shall notify the Borough Administrator/Secretary of the type, make and model of any mobile home moved into such mobile home park. Within 10 days of the date of removal of any mobile home from a mobile home park within the Borough of Slippery Rock, the owner, operator, manager or agency for owner shall notify the Borough Administrator/Secretary of the intention to move said mobile home and the destination of the mobile home.

Any person who violates or permits a violation of this article shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this article in equity in the Court of Common Pleas of Butler County.

There are hereby established regulations for the issuance of a rental operating license:
A. 
No person shall operate as a rental unit a single-family dwelling unit, multiple dwelling, apartment building, townhouse, conversion unit, or dormitory unless he holds a current unrevoked operating license issued by the Code Enforcement Officer in his name for the specified rental unit.
B. 
Upon completed application, all rental units shall be inspected for compliance with this article. Violations will be noted and processed according to this section prior to issuance of the operating license.
C. 
Every operating license shall be issued for a period of two years, unless sooner revoked, and may be renewed for successive periods not to exceed two years. The initial operating license may be issued for a period of one year at the discretion of the Borough Code Enforcement Officer, in order to bring a dwelling unit into compliance with the Property Maintenance Code or to maintain the inspection sequence of the rental operating license program.
D. 
Each rental unit will be inspected and shall comply in full with Slippery Rock Borough's Property Maintenance Code, designated as the International Property Maintenance Code, 2003 Edition (or currently adopted edition), as published by the International Code Council, as adopted as the Property Maintenance Code of the Borough of Slippery Rock,[1] for regulating and governing the conditions and maintenance of all property, buildings and structures by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupancy and use.

E. 
Right of entry. The Code Enforcement Officer is authorized to enter the structure or premises at reasonable times to inspect, subject to constitutional restrictions on unreasonable searches and seizures. Prior to entering into a space not otherwise open to the general public, the Code Enforcement Officer shall make reasonable effort by telephone or letter to locate the owner or other persons having charge or control of the premises, present proper identification and request entry. If requested entry is refused or not obtained, the Code Enforcement Officer shall pursue recourse as provided by law.
F. 
The cost for the license to operate a rental dwelling shall be established by Borough Council from time to time by resolution,[2] based on the type of residential structure and number of dwelling or rooming units.

G. 
The owner or agent of the owner of a residential rental property licensed as per the provisions of this article shall file with the Code Enforcement Officer a completed unverified condition report for those intervening years when an inspection is not scheduled. Such report shall be on a form provided by the Borough. Failure to file such report within 30 days, upon notice, shall constitute a violation of this article and subject the owner or agent of the owner to all applicable penalties.
H. 
Responsibility. The owners of the premises shall maintain the structures in accord with all legal requirements, guarantee occupancy as defined in § 221-7 of this article, and insure that the property is in compliance with these requirements.
As used in this article, the following terms shall have the meanings indicated:
FAMILY
As defined in Chapter 375, Zoning, of the Code of the Borough of Slippery Rock.[1]

Rental units shall be inspected and approved for occupancy as follows. The administration and enforcement of this Code within the Borough of Slippery Rock shall be undertaken in either or both of the following ways, as determined by Borough Council of Slippery Rock from time to time by resolution:
A. 
By the designation of an employee of Slippery Rock to serve as the municipal code official to act on behalf of Slippery Rock Borough;
B. 
By retention of one or more construction code officials or third-party agencies to act on behalf of Slippery Rock Borough.
Any person who violates or permits a violation of this article shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings.
