As used in this chapter, the following terms shall have the
meanings indicated:
A structure of concrete masonry or other relatively impervious
material intended for bathing or swimming purposes and provided with
a controlled water supply and shall include portable pools at least
12 inches in depth.
It shall be unlawful to construct, enlarge or maintain any outdoor
swimming pool in the Town except in compliance with the provisions
of this chapter.
A.
All existing swimming pools as defined in § 370-1 must be registered at the office of the Building Inspector within 30 days of the enactment of this chapter by the representative Town meeting.
B.
All swimming pools, as defined in § 370-1, placed, installed or constructed in the future must be registered at the office of the Building Inspector within 30 days after the completion of placing, installing or construction of the swimming pool.
C.
The Building Inspector shall collect for each registration of an
existing pool and for pools placed, installed or constructed in the
future a fee of $1.
All swimming pools, except portable pools which are at least
four feet in height above the underlying ground, must be completely
enclosed, including the access and ladder area, by a fence at least
four feet in height above the underlying ground.
A.
All fences and gates must be constructed either of wood or wire mesh
not less than No. 11 gauge or of chain link at least four feet above
the underlying ground, and said fences shall have no aperture or opening
exceeding two inches at any point. Posts and crosspieces of any wooden
fence shall be placed on the inside or pool side of said wooden fence.
Picket fences are permitted when spaces between pickets do not exceed
two inches.
B.
All gates shall be equipped with self-closing and self-latching devices
placed at the tops of the gates. All gates shall be locked whenever
the pool is unattended.
C.
Any climbable or accessible platform must be removed from the pool
area when not in use or fenced in.
