[Adopted as Ch. 15, Art. II, of the 1989 Code]
Pursuant to the authority granted by Chapter 126 of the General
Statutes, there is hereby created a planning commission with all the
powers and duties specified by state law.
The Planning and Zoning Commission shall consist of seven members.
The Planning and Zoning Commission shall have all the powers
and duties specified in Chapters 124 and 126 of the General Statutes
and is designated as a planning and zoning commission for the Town.

A.
There shall be four alternate members to the Planning and Zoning
Commission.
B.
As terms of alternate members expire and as vacancies occur, further
appointments shall be made by the Southington Planning and Zoning
Commission.
C.
No more than two of the alternates shall be of the same political
party.
D.
If a regular member of such commission is absent or is disqualified
from acting, the Chairman of the Commission shall designate an alternate
to act, taking into consideration the political party of the member
not available, the requirements of the state statutes and Charter
provisions concerning minority representation, attendance of the alternate
members at prior Commission meetings, as well as equality in opportunity
to serve.

A.
Designation and membership.
(1)
In accordance with the provisions of C.G.S. § 22a-354a
et seq., the Planning and Zoning Commission is hereby designated as
the aquifer protection agency (hereinafter the "agency") of the Town
of Southington. (The staff of the Town of Southington shall serve
as the staff of the agency.)
(2)
Members of the Planning and Zoning Commission shall serve coexisting
terms on the agency. The membership requirements of the agency shall
be the same as those of the Planning and Zoning Commission, including,
but not limited to the number of members, terms, method of selection
and removal of members, and filling of vacancies.
(3)
At least one member of the agency or staff of the agency shall complete
the course in technical training formulated by the Commissioner of
the Department of Energy and Environmental Protection of the State
of Connecticut, pursuant to C.G.S. § 22a-354v.
B.
Regulations to be adopted. The agency shall adopt regulations in
accordance with Connecticut General Statutes, § 22a-354p,
and R.C.S.A. § 22a-354i-3. Said regulations shall provide
for:
(1)
The manner in which boundaries of aquifer protection areas shall
be established and amended or changed.
(2)
Procedures for the regulation of activity within the area.
(3)
The form for an application to conduct regulated activities within
the area.
(4)
Notice and publication requirements.
(5)
Criteria and procedures for the review of the applications.
(6)
Administration and enforcement.
C.
Inventory of land use.
(1)
In order to carry out the purposes of the aquifer protection program,
the agency will conduct an inventory of land use within the area to
assess potential contamination sources.
(2)
Not later than three months after approval by the Commissioner of
the Connecticut Department of Energy and Environmental Protection
of Level A mapping of aquifers, the agency will inventory land uses
overlying the mapped zone of contribution and recharge areas of such
aquifers in accordance with guidelines established by the Commissioner
pursuant to Connecticut General Statutes, § 22a-354f. Such
inventory shall be completed not more than one year after authorization
of the agency (C.G.S. § 22a-354e).
